<br />Council Minutes of 12/21/93 <br />Law Director Gareau reported: 1) Last week a pre-trail hearing was held before <br />Judge Gaul on the Eliza Jennings case. Although we would have preferred that <br />Judge Gaul simply enter judgment on behalf of the city, he indicated he would do <br />that after we resubmitted our motion for sw~ary judgt~ent. The attorneys for <br />Eliza Jennings were not pleased that Judge Gaul indicated he would award the city <br />$106,000; however, he has not agreed to give tree city interest from the date of <br />the Supreme Court judgment. Iiapefully, final judgment in this case will be made <br />within the next 30 days. Should Eliza Jennings appeal, wee will request that they <br />put up a supersedeas bor~cl for $106,000. <br />2) The $1.2 million Nova development case has been dismissed. <br />3) The referee assigned to the Deerfield case has notified t~ Law Director that <br />the judgment entry has been signed. Once it is recorded, the property will <br />officially be vested in the city. <br />4) A mediation hearing will be held in Federal Court on the Robinson case, and on <br />January 7 a deposition will be taken from the testing company in California. <br />Finance Director Burns reported: 1) On November 16, he attended a meeting of the <br />Cleveland Chapter of the Ohio Society of CPA's. The guest speaker was the Chair- <br />person of the Government Accounting Standards Board, which is the organization <br />that makes the accounting rules for tree government sector. <br />2) Ordinance No. 93-159, a $4.1 million note ordinance for the acquisition of a <br />golf course, is on this evening's agenda. The fiscal officer's certificate has <br />been presented to the Clerk of Council. in the text of that certificate, are <br />projected revenues and matures for the acquisition which indicate that the <br />revenues from this facility will pay the debt service. <br />3) The 1993 Tax Act provides that cancelled checks are no longer acceptable as <br />evidence of a charitable contribution. Therefore, a memo will. be sent to all <br />city departments that receive contributions notifying them that receipts will <br />have to be issued to all donors. <br />Mr. McKay, Chairperson of the Environmental Control Committee, reported: 1) The <br />committee met on Tuesday, December 21, and in attendance were Council Members <br />Leonard, Nashar, Bahas, McKay; City Engineer Deichmann; Councilman-elect Limpert. <br />The conmi.ttee discussed Ordinance 93-i49 which deals with sewer connections to <br />the main line owned by the city. Presently, contractors of multiple units are <br />making multiple connections but only one connection at the street. This practice <br />may result in future problems because blockages could occur at the point where <br />the several connections tie into one. <br />2) Mr. McKay moved that Council approve a liquor permit transfer from Steve <br />Nikolakis, 25905 Lorain Road, to City Club Inc. of Northeast Ohio, 25905 Lorain <br />Road; second by Mr. Leonard; motion passed unanimously. <br />3) Mr. McKay .moved that Council approve a liquor permit transfer from Ruggers, <br />Inc., 5116 Great Northern Plaza South, to Showbiz Pizza Time, Inc., 26104 Great <br />Northern Shopping Center; second by Mr. Leonard; motion passed unanimously. <br />Mr. Lind, Chairperson of the Finance Committee, reported: 1) The committee met <br />on December 15 and in attendance were the committee members; Council Members <br />Nashar, McKay, Musial; Finance Director Burns; Service Director Bohlmann. The <br />following items were discussed: <br />a. Ordinance 93-144, an .appropriation to purchase six police cars. This <br />legislation will be tabled because the appropriation Ordinance 93-120 will fund <br />the purchase of the police cars.
