Council Minutes of 12/21/93 <br />LEGISLATION (continued) <br />structures located thereon; fixtures, furnishings and equipment; sprinkler, <br />underground drainage and water distribution systems and related site improve- <br />ments; all together with the necessary appurtenances thereto, for use as a golf <br />course and recreational and cartrnuiity center. <br />Ordinance No. 93-160 was introduced and placed on first reading by Mayor Boyle. <br />An ordinance to establish within the Proprietary Fund Group a "Golf Course Fund" <br />of the City of North Olmsted. <br />Resolution No. 93-162 was introduced and placed on first reading by Mayor Boyle. <br />A resolution authorizing the Mayor to negotiate an agreement for the purchase of <br />Springvale Country Club to be used by the City for recreational purposes, and <br />declaring an emergency. Mr. Lind moved for suspension of the rules requiring <br />three readings and committee review; second by Mrs. Babas; motion passed <br />unanimously. Mayor Boyle commented for the record that Resolution 93-162 was <br />being passed under suspension of the rules to allow formal negotiations to <br />proceed. Also, he noted that the amount quoted, $4,100,000, was not necessarily <br />the cost of the properties. By passing the ordinance, Council will not be <br />mandating the cost, but rather establishing a ceiling. Mr. Lind moved for <br />adoption; second by Mrs. Babas; motion passed unanimously. Resolution No. 93-162 <br />adopted. <br />Ordinance No. 93-163 was introduced and placed on first reading by Mr. Nashar. <br />An ordinance authorizing the Mayor to submit an application to the Northeast Ohio <br />Areawide Coordinating Agency for the city to participate in the State Transporta- <br />tion Enhancement Program for the construction of noise barriers, mounding and <br />landscaping along a portion of the proposed Crocker Road in North Olmsted, <br />agreeing to share in the project cost, agreeing to the future maintenance of said <br />improvements, and declaring an emergency. Mr. Nashar moved for suspension of the <br />rules rer~uiring three readings and committee review; secor~. by Mrs. Babas. Roll <br />call: Nashar, yes; Babas, yes; Leonard, yes; Nfusial, yes. Before voting, Mr. <br />McKay expressed concern about the project cost and .asked. whether a definite cost <br />would be presented to Council. A lengthy discussion ensued as to the purpose of <br />this legislation. The legislation had originated in the Engineering Department; <br />consequently, the Law Director had riot had a chance to study the legislation. In <br />addition, the Mayor had been ill and had not seen a copy. Finance Director Burns <br />explained that, at some point in time, the money would have to be made available <br />through appropriation for the city's funding before he could sign the certificate <br />and before the grant could be finalized. With that explanation, Mr. McKay voted <br />"yes" on the motion to susperxi the rules for three readings and committee review; <br />Mr. Lind votes "yes" on the motion; the motion passed unanimously. The <br />discussion continued since members of Council, the Mayor and Law Director were <br />unhappy with the wording of the legislation. The Mayor suggested that he would <br />speak to City Engineer Deichmann about the legislation; and, if everyone's <br />reservations were confirmed after that discussion, he would veto the legislation. <br />Mr. Gareau suggested that Council amend the legislation to delete Sections 2, 3, <br />4 and 5. The amended ordinance would simply authorize the Mayor to file an <br />application and not commit the city to funding. The legislation could be <br />repealed at a later time if necessary. Mr. Nashar moved to amend Ordinance <br />No. 93-163 by deleting Sections 2, 3, 4 and 5; second by Mr. McKay; motion passed <br />unanimously. Ordinance No. 93-163 was amended. Mr. Nashar moved to suspend the <br />rules requiring three readings and committee review on Ordinance No. 93-163 as <br />
