Council Minutes of 10/19/93 <br />Audience Participation <br />Tom tester, 4rter Road, spoke on behalf of Visions, a group of North <br />Olmsted residents who would like City Council to pass legislation regarding the <br />-location of super stores within the city. They woaild like action to be taken as <br />quickly as possible in order to protect the city from similar proposals to the <br />Wal-Mart store. <br />Cindi Buechler, 4733 Porter Road, asked about the status of the sager. store <br />legislation previously suggested by Paul Miller. Law Director Gateau said hde h <br />begun researching the issue and that it would be two or three weeks before the <br />legislation could be prepared. He explained. that ante the legislation is <br />introduced, it would go to Planning Ccxanission for their report and rec <br />tions. In addition to three readi.ar at Council mieetings, the legislation would <br />be discussed in a Council committee a€xi a public hearing mould be ~e].d. Because <br />this is a zoning issue, the City Charter prohibits the waiving of three Council <br />readings and the 30-day waiting period after the legislation i.s passed. I3ow+ever, <br />Council is not precluded frcxn calling special meetings in order to meet the three <br />reading requirement. Mrs. BaY~as asked whether another super store would be <br />exempt from the requirements once the legislation process has begun. Mr. Gateau <br />stated that, if a permit has been issued before the regulations have been <br />changed, then the changes do not apply to that permit. Mrs. Buechler wanted to <br />know if Council wr~uld actively and quickly pursue this issue, and she was assured <br />that was Council's intention. <br />Robert Strnad, 4861 Porter Road, asked if the Mayor or any Council Member would <br />benefit financially frcm the alternate site chosen by Walrt. Mr. Strand was <br />told that the answer to his question was IUD! Mr. Straad questioned if the water <br />for the Moen building was coming frosr the city transfer plant. Mayor Boyle <br />explained that North OLnsted dAes not process potable water--we have a wastewater <br />treatment plant. The water will come from the City of Cleveland. <br />Margaret McKay, 5197 Columbia Road, wanted Mr. Strnad to know that the McKay <br />family owns no other property in the city other than their own home. <br />Paul Miller, 3941 Pine Circle, regeated his request that the Administration <br />attempt to negotiate with Sherwin Williams in obtaining the property for use of <br />the senior citizen facility. He would like to see that property used for some- <br />thing other than a super store. As treasurer of the .Friends of the Family <br />Coannittee, Mr. Miller extended an invitation to everyone to make a donation <br />because it is important to educate the voters on this issue. The following <br />people have already made pledges: Mayor Boyle, $500; Jim Boehn~er, $100; Pat <br />Babas and John Fairfield, $100; Dean and Margaret McKay, $100; Paul Miller, $100. <br />The cosrnnittee has received donations of $100 frost the senior citizens group and <br />$25 from Duane Limpert. <br />Mrs. Babas asked if the building of the senior housing would be jeopardized by <br />the failure of Issue 23. The Mayor said that it could be .jeopardized, especially <br />by the loss of the $300,000 grant. Mayor Boyle said that the problem with the <br />issue is people do not realize it will not take away a ;vote but rather removes <br />the requirement of a mandatory vote. Mr. Gateau explained that the city is not <br />bound by its own zoning laws; but, .since others will be involved in the campus- <br />type project, we need the flexibility of the Charter amend~~nt. <br />5 <br />
