Council Minutes of 9/21193 <br />~: <br />'` senior housing on any one specific site; it is for the whole city. Passage of <br />this amerxlment will not change the basic process for senior housing.. Any project <br />will still go through the Plar~aning Comxaission arxi be submitted to Council for <br />approval. The marxatory vote of the residents will no longer be required. <br />However, the public always has the right to vote an a project if they do not went <br />it in a proposed location. The twill simply speed up the process and <br />allow senior housing to be built in a more logical marg. <br />Mr. Leonard and Mrs. Babas questio~d the Mayor on haw promotions for the DARE <br />officer would be handled since he .will not be participating i=a the everyday <br />activities of the Police Department. Mayor Boyie said this issue had been <br />addressed by DARE. While the DAME officer carrot perform as the mrmal Police <br />officer 3b5 days a year, he is in fact a Police officer and can be called out in <br />emergencies. Also, during s~oer months he will be used p~itly as a <br />Police officer. Officer will be aware of promaticxfal tests and will be <br />able to take the tests. He will not be a DARE officer for his emtire career. <br />The program will be set up so that there will be two RARE officers, and Officer <br />Adamson will be the senior officer at this titse. When he decides to take a <br />promotion or retire from DARE, the second officer will move up to the senior <br />position. <br />Law Director Gareau reported: 1) With regard to the Halleen case, their "expert" <br />witness has been deposed. As a result of the deposition, we have filed a motion <br />in limine to exclwde his testimcexy on the gr that he is mt an exp~trt. <br />2) An eviction has bean fill t Juanita Edwards who is occupying the house <br />where the new fire station is to be built. Ms. Edwards has refused to leave. <br />3) Next week, negotiations will begin with the Regional Transit Authority <br />regarding extension of the existing contract. <br />4) Has filed a motion to make a definite statement in the Nova case. The <br />attorney for the plaintiff has purposely side-stepped the issue of a contract <br />between Cuyahoga Crnmty sod North Opted atxi is alleging that we have scxne duty <br />to provide sewer service to Olmsted Township but not telling the basis of that. <br />Once the basis of that is known, this case will be thrown out because it is based <br />on contract and root tort. <br />4) A brief has been filed with the American Arbitration Association with regard <br />to premium pay in the Service Department. <br />5) The Patricia Scott grievance arbitration is set for January of 1994. <br />Finance Director Burns reported: 1) There are three note ordinances on first <br />reading tonight: Ordinance No. 93-122 which fiuxis computerization within the <br />city; Ordinance No. 93-123 which funds revamping of the electrical. wiring system <br />and aback-yup generator system for City Hall ar~d otY~er buildings; Ordinance No. <br />93-124 which funds the remodeling of the City Hall storage area into office space <br />and a conference room. The Clerk of Council is in receipt of the three fiscal <br />officer's certificates. <br />2) Has asked the bond ucxierwriters to look into the feasibility of advance <br />refurniing of the 1985 bond issues. Those are currently at an interest rate of <br />9a~. We're looking at the possibility of going out to bond and reducing the <br />interest rate to approximately 5~~. <br />3) The new DUI law that has gone into effect in the State of Ohio requires the <br />city of residence of the convicted person to impourxi or immobilize the car, even <br />2 <br />n ~:-,,., . ~~ .. <br />
