Council Minutes of 7/6/93 <br />Law Director Gareau reported: 1) Tomorrow a preliminary injunction hearing will <br />be held concerning the AFSCME case. This case imrolves a union grievances dealing <br />with the Civil Service provisions that require the testing of position within 60 <br />days after a provisional appointment has been made. We have sub~i.tted a five <br />page document with respect to stipulations, anti aver 100 pages of dc~cue~nts have <br />been submitted as stipulateri doe rents. A motion in limine has been prepar+~d and <br />will be filed tomorrow. ~.s i.s an important case for all (7hio cities because it <br />will protect a city's right to utilize a Civil Service system in original <br />appointments versus the union's position that the union contract takes precedence <br />over Civil Service. <br />2) The appeal that had been filed in the Dorsey case, where a young man had <br />fallen an a delineator stake, ties been dismissed. That case is now concluded, <br />and the city is not responsible for the personal injury claim. <br />3) The enterprise zoo agreement for Money Access Service Corp. has been <br />prepared. <br />4) With respect to the civil rights lawsuit, we have filed for an extension of <br />time to prepare the city's answer. The insurance carry has retained legal <br />counsel. We have advised the insurance cc~pany that, since back wages are being <br />requested and this is not covered by insurance, our Law Department will co-handle <br />the case. <br />5) A final payment of $4,500 has been received in the firefighter case-where the <br />firefighter had received insurance proceeds in a personal injury claim and. had <br />failed to pay J. P. Farley. <br />6) We have received the judgment entry from Probate Court dealing with the <br />appropriation of property for the neta fire station. We are having sc~e problems <br />with the tenant who lives on the property. A notice to leave premises has been <br />prepared, and the tenant will have until August 1 to move. If she fails to <br />leave, an eviction proceeding will be filed in Rocky River Municipal Court. <br />Mayor Boyle commented as to the enterprise zone. agreement with Money Access <br />Service Corp. that the plan haci been presented to the County Commissioners, acid <br />they had. voted unanimously for the project. In addition, because Mr. Gareau had <br />saved the ccmrpany money by preparing the legal agreement, they have agreed to <br />issue the city a check for a portion of their savings. <br />Finance Director Burns reported: 1) Money Access Service Corp. has issued the <br />check to the city in the amount of $2,250. <br />2) Ordinance 93-87, which is on third reading tonight, will adapt the budget for <br />the fiscal year 1994 and will be submitted to the County Auditor. The General <br />Fund is $12,581,000, and the total of all funds is $30,000,372. This may <br />increase next year should there be additional borrowings. <br />Mrs. Beringer, Chairperson of the Building Zoning and Development Committee, <br />reported: 1) The committee met on June 21, ar~d in attendance were cos~mittee <br />members Nashar, Lind, Beringer; &~.i.ld.ing Commission Conway; Assistant Fangir~er <br />McDermott. Agenda items were as follows: <br />a. Stemmer Auto Body, 29930 Lorain Road, a proposal to approve a recently built <br />4x10 foot addition for an office expansion. Mr. Stemmer was in attenrdance. A <br />variance was granted by the BZA on June 3, and the comni.ttee members had. no <br />objection. Mrs. Beringer moved to approve a special permit for anon-conforming <br />structure and addition for office expansion; seccmd by Mr. Nashar; motion passed <br />unanimously. <br />2 <br /> <br />
