Council Minutes of 6/15/93 <br />11) On Thursday, Jwne 17, Mayor Boyle will leave for New York to attend the U. S. <br />Conference of Mayors. The Mayor is the national chairperson of the tax <br />committee. The Conference will be meeting an the financing bill that President <br />Clinton has put before Congress. .Also, the Conference will. discuss the concept <br />of having presidential candidates rein urban areas early so that these areas <br />have a voice in deciding on the candidates and the issues. <br />12) All fathers are wished a Happy Fathers' Day this Sunday. <br />Law Director Gateau reported: 1) Last week, the city was served with a summons <br />in Federal Court alleging discrimination ar~d unfair treatment with respect to the <br />housing inspector test. A black male, age 63, took the test ar~d scored beyo~xi <br />the break point and was not considered for the two open positions. He filed with <br />the Ohio Civil Rights Commission claiming discrimination. The coa~laint wss <br />dismissed in favor of the City of North OLnsted, and the Co~:i.ssion indicated <br />there was r~o discrimination. However, they did issue him a right to sue letter; <br />and he has filed suit in Federal Court. This has been f©rwarded on to the city <br />insurance carrier to determine whether or not there is coverage. The suit <br />alleges that the test was racially biased. Therefore, the city will ask that the <br />company that prepared the test be made a third party defendant because, if a <br />racially biased test was prepared, it was unbeknownst to the city. <br />2) The complaint against AFSCME has been filed. A te~orary restraining order <br />has been granted which prohibits the union from taking the Haotman g~cievance to <br />arbitration. On July 7, a hearing will be held to determine if a preliminary <br />injunction will be granted. A preliminary injunction will stay the proceedings <br />.until the trial. <br />3) Today, four of the members of the Board of Zoning Appeals were deposed with <br />respect to the Halleen case. <br />4) A final judicial report has been ordered and will be filed with the Court of <br />Common Pleas in order to proceed with the default judgment regarding the <br />Deerfield recreation land. <br />5) Council will hold an executive session this evening to discuss threatened <br />litigation dealing with the sewage treatment plant. <br />6) The real estate for the fire station has not yet been acquired because the <br />City Charter requires us to wait until June 26 to deposit the funds from the sale <br />of the notes. Once the funds have been deposited with the Probate Court, a deed <br />will be issued. <br />Finance Director Burns reported: 1) Ordinance 93-92 authorizes $150,000 in notes <br />for engineering services for street programs. The Clerk of Council has bin <br />given the fiscal officer's certificate. <br />2) Today, the $3.4 million rx>te issue was sold with an interest rate of 2.94%. <br />3) The Regional Income Tax Agency has begun a program of looking into comt~ercial <br />taxpayers. A number of employers in North Olmsted have not increased withholding <br />to 2%. The estimated $140,000 of uncollected taxes will be assessed to the <br />employers. <br />4) The world of municipal finance is currently undergoing significant changes. <br />Rep. Dingle, Chairperson of the House Energy and Commerce Committee, and Rep. <br />MarlF.ey, Chairperson of the Telecam~i.cations and Finance sub-committee, have <br />begun a project to look into the Tower amt that prohibits the Securities <br />and Exchange Coa~nssion and the Municipal Securities Rule-Making Board fratn <br />requiring municipal issues to file disclosure documents before an issue is made. <br />3 <br /> <br />
