He attempted to sue Judge Gravers arxi Clerk of <br />Courts Ben. Wright. Those clam were dismissed by Judge Bautista. Mr. Gateau is <br />in the process of coordinating a defense with the insurance company that insures <br />the city Police Department since three members of the department are named in the <br />lawsuit. The city is not a party to the lawsuit. <br />2) Henry Robinson has resigned from the Civil Service Commission. <br />3) This past Monday, spoke at the Law Directors' luncheon regarding litigation <br />involving the City of North Olmsted. <br />4) Met today with the AFSCME Clarks Union to finalize language in the contract. <br />5) Along with other city officials, is negotiating a new cable contract. <br />Mr. I~sial presented the following hypothetical scenario to Law Director Gateau: <br />A juvenile apprehended by the Police Department puts up a struggle and bites the <br />officer, drawing blood. Does that child have a constitutional right of i~~*+~ty <br />to avoid a test for AIDS? Mr. Gateau said that a recent Supreme Court case held <br />that a person's blood and body fluids caul.d be withdrawn without consent. He <br />does not feel that age would make arty difference. Mr. Musial feels that the <br />general populace does not realize what a great risk the police force is under in <br />these types of situations. Mr. Gateau agreed and added that the Fire Department <br />was also at risk. <br />Finance Director Burns reported: 1) Governor Voinovich's proposed budget <br />contains a formula for sharing revenues with municipalities which will freeze <br />them at 1992 levels. When the appropriation for this year was done, he chose to <br />use the revised lower numbers which had been provided. Therefore, if the <br />Governor's proposal des not pass, the city will have additional funding. <br />2) Ordinances 93-48 and 93-49, dealing with the funding of the purchase of afire <br />truck and service department vehicles, will be ~ first reading tonight. The <br />fiscal officer's certificates for these note ordinances have been presented. <br />Mr. Nashar, who chaired the BZD Committee meeting in Mrs. Saringer's absence, <br />reported: 1) The meeting was held on March 23 with Building Cosmissioner Conway <br />and Council Members Lind and Nashar in attendance. The following item was <br />discussed: <br />a. Ordinance 92-165, which was amended in Section F-103.1 by deleting the words <br />"hot tub or spa" and by adding Section F-103.2 which reads, "Hot Tub or Spa: A <br />hot tub or spa shall be equipped with a suitable cover which can be securely <br />fastened and locked when not in use." The committee recommended approval of the <br />ordinance with the ameru~nients. <br />Mr. McKay, Chairperson of the Envirorgnental Control Committee, reported: 1) The <br />committee met on Monday, March 22, to discuss Resolution 93-30. This legislation <br />authorizes the Mayor to enter into a contract with BFI to implement a recycling <br />program for apartments. The cost is $1.50 per unit per month. BFI will begin <br />with the apartment units that they currently serve. Once that gets underway, <br />they will draw up agreements with the remaining units.
