Council Minutes of 3!16/93 <br />3) With respect to the case of the firefighter's spouse receiving a personal <br />injury settlement, the city was entitled to reimbursement for the costs of <br />medical treatment. The Law Department filed suit in Rocky River Court to recover <br />these costs, and the suit has been settled. The party will repay the amount that <br />was subrogated. <br />4) The case involving a young man in the Deerfield subdivision who fell on a <br />delineator stake is winding down to trial. On Thursday, a deposition will be <br />taken from the city employee who is in charge of signs. <br />5) With respect to the Kerner case dealing with land for the fire station, Judge <br />Corrigan in the Probate Court has ruled in favor of the city and basically <br />indicated that the city has the right to a~rapriate the property. The only <br />issue remaining is the price. The appraisal on the land was $192,000. <br />6) This year, Mr. Gareau will act as legal counsel to the Westshore Council of <br />Governments. It will be a particularly interesting gratifyiz`g year because <br />the communities will be dealing with establishing a regional misdemeanant jail. <br />Finance Director Burns reported: 1) The city has been .looking into some low <br />interest notes from the Ohio Public Works Caaamission to handle future and past <br />sanitary debt. Recently, the Federal government ct~nged its EPA grant program to <br />basically a program where money is given to States to establish a revolvinfg loan <br />fund at low interest rates, but not out-right grants to cities. Because of these <br />regulations, the loans cannot be used for a city's share of former grants. <br />Therefore, our previous borrowings cannot be refunded with this type of debt. <br />Future debt, which includes our current notes that are outstanding and future <br />notes that will be used to improve the Wastewater Treatment Plant, could be <br />financed through these low interest Ioans. The program is advantageous because <br />of the low interest, 4.7X compared to 6'~~, and because there are no underwriting <br />costs to issue bonds. Next week, we will meet with the representatives of the <br />Ohio Public Works Commission to work out. the details. <br />Mrs. Saringer, Chairperson of the Building, Zoning and Development Committee, <br />reported: 1) The committee met on Monday, March 15; in attendance were cor~aittee <br />members; Mr. Kacirek; Mr. Tilberg from CEI; Pat Graham from the Chamber of <br />Coarmerce; Mayor Boyle; Paul Grayshaw, city electrical inspector; Service Director <br />Bohlmann. Agenda. items were as follows: <br />a. Ordinance Nos. 92-102 and 92-103 care discussed with respect to the <br />recommendations made by CEI and the Chamber of Commerce. With the expertise of <br />the Building Department, Service Director Bohlmarnz, and Mr. Tallon ~o originally <br />sponsored this legislation, we will be reviewing these ordinances. If amendments <br />are made, another public hearing will be held. however, for the present, these <br />ordinances will be placed on hold. <br />b. Ordinance No. 93-20 which will adopt the National Electric Code was <br />discussed. The committee had no objections to this legislation. <br />c. Ordinance 93-25 which authorizes and directs the City Engineer to accept and <br />record a dedication plat establishing additional right-of-way for Duane Road. <br />The committee had no objections to this legislation. <br />3 <br />~«,~« ~v9~! ~yrwa~~ ~, . _ . <br />,~, <br />
