Council Minutes of 2/16/93 <br />8) ~e appropriations for 1993 have been submitted in a slightly different <br />format. A cover letter and worksheet have been supplied to Council. 'The new <br />format is based on programs and. projects rather than individual line items. This <br />should be more result oriented grid will give us the ability to address the needs <br />of the city in a more efficient mariner. Council's input will be appreciated. <br />Law Director Gareau reported: 1) With regard to the Halleen case, the Planning <br />Commission and Board of Zoning Appeals had agreed that a 12 foot green strip with <br />landscaping would be acceptable in lieu of the 75 foot setback. However, <br />Halleen's attorney would not accept anything other than a 7 foot green strip. <br />Consequently, the Board of Zoning Appeals has rejected Halleen's application for <br />a variance. We have gone back to court on this issue, and a pre-trial date has <br />been set for May 18. <br />2) Last week the court issued an order in the firefighter's case for both sides <br />to submit stipulations either that there .were no benefits paid to part-time <br />employees of the City of North Olmsted and any and. all ordinances that the City <br />had dealing with benefits, particularly vacation benefits to part-time employees. <br />The other party would not stipulate that there were no such ordinances and rio <br />benefits were given to part-time employees. Consequently, we will go buck to the <br />court for direction on what information is needed. At this point, if we are <br />required to give a benefit, it will be one week of vacation to the former Capt. <br />Smith. However, two other employees could potentially benefit from their <br />National Guard service. This same issue has arisen in the City of Fairview Park. <br />3) On February 16, attended the Cuyahoga County Law Directors' Conference. One <br />of the cases discussed was the North Olmsted private detective case. Although <br />the city lost this case, it did help to straighten out the interpretation of hmme <br />rule powers for cities in Ohio. Another North Olmsted case that was discussed <br />was the firefighter's case. <br />Mrs. Saringer, Chairperson of the Building, Zoning and Development Committee, <br />reported: 1) A public hearing on Ordinance 92-102, which deals with commercial <br />lighting, had been held earlier in the evening. Council was asked by CEI and the <br />Chamber of Commerce to remove the ordinance fran the agenda. <br />2) The Building, Zoning and Development C~snittee will meet at 7 p.m. on <br />Wednesday, February 17. <br />Mr. Lind, Chairperson of the Finance Committee, reported: 1) The committee met <br />on Tuesday, February 9; in attendance were Council Members Musial, Saringer, <br />Lind; Mayor Boyle; Service Director Bohlmann; Safety Director Gundy. The <br />following items were discussed: <br />a. Ordinance 93-9, which is an ordinance establishing the organization and <br />compositicm of the non-~iform part-time personnel of the Police Department. The <br />increase in salaries will be 4i%, and the committee recommended approval. <br />b. Resolution 93-12, which authorizes the Director of Public Service to <br />advertise for bids for uniforms for the Wastewater Treatment Plant aril Service <br />Department personnel. Currently we have a contract with Cintas that provides <br />five changes per week for each employee. Since the cost exceeds $10,000 for the <br />year, bids are required.
