_, . <br />Council Minutes of 12/20!94 <br />agreed and said that the pending legislation would make it more difficult for a city to <br />annex a neighboring townal~. Therefore, in order to get a yep ahead of that legislation, <br />Council had to have a first reading before the end of the year. As far as a vote of the <br />people of North Olmsted, the Ohio Revised Code does not provide for such a vote. Mrs. <br />Bahas explained that North ed was pursuing the amcexation because it would <br />provide benefits for both communities. Gins about street repairs and other costs to <br />North Olmsted taxpayers have been asked in previous s. It is her und~ding <br />that the county will make reQairs to streets ffi the Township. Mr. Bomar explained that <br />this legislation had been assigned to the Legislative Committee, whi,~ is .chaired by Mr. <br />McKay. All committee meetings are open to the public, and Mr. DeChant will be notified <br />of the meeting date. (Law Director Gareau arrived and took his seat at this point) Mr. <br />Gareau explained to Mr. DeChant that the method of annexation provided for in the Ohio <br />Revised Code does not require a vote by the re~dents of North Opted. Council votes <br />on the legislation as the elected representatives of the people. The North Ohmaed City <br />Charter does make it possinle for re ' is to place issues ~ the b through initiative <br />and/or referendum petitions. However, Stye law does not provide fcrr propoions to be <br />placed on the ballot as is done in Cakfvma. Mr. DeChant expressed ecrncern because the <br />legislation includes an "emergency clause." Mr. Li~ert explained that this clause simply <br />makes the legislation take effect ' ' tely upon passage and the signature of the <br />Mayor. Without the emergency clause in effect, legislation does nat take effect for thirty <br />days. Mr. Gareau further explained that this 1 'on requires the enc~ergency clause <br />because of the time constraints of getting it ~ the ballot for the May election rather than <br />waiting until November. This does become. an issue because the State Legislature is <br />considering legislation to make annexation more difficult. Mr. Gareau feels that this issue <br />should be approached in a positive manner, looking for the benefits such as a greater tax <br />base. Mr. DeChant expressed concerns about sewer and flooding problems. Mr. Gareau <br />explained that because of the typography of the land, the annexed pow of the Township <br />would not be part of the North Ohm~ed sewer system The new Southwest Interceptor <br />of the Regional Sewer District will go down Bagley Road to Stearns Road and will pick <br />up the Township. Mr. DeChant exlressed eoflcein that the annexed part of the Township <br />would experience the same problems as North Olmsted has had during its growth years. <br />LEGISLATION <br />Ordinance No. 94-159 introduced by Mayor Boyle and the entire Council was given its <br />third reading. An ordinance authorizing the Personnel and Admini~rative Services <br />Director to advertise for bids for a group life insurance program to cover fil-time non- <br />bargaining unit employees as amended. Mr. McKay moved for adoption; second by Mr. <br />Nashar; motion passed unanimously. Ordinance No. 94-159 adopted. <br />Ordinance No. 94-163 introduced by Mr. McKay was given its third readimg. An <br />ordinance authorizing the Director of Public Service to make emergency repairs on the <br />vacuum filter system at the Wastewater Treatment Plant, without public bd~g, and <br />declaring an emergency. Mr. McKay moved for adoption; second by Mr. Nashar; motion <br />passed unanimously. Ordinance No. 94-163 adopted. <br />4 <br />
