Council Minutes of 7/5/94 <br />LEGISLATION <br />Ordinance No. 94-44 introduced by Mayor Boyle was given its third reading. An <br />ordinance authorizing the City of North Olmsted to abate its cause of action against <br />Patricia J. Martin and James A. Beans, Director of Fiteance, for the illegal exp~diture of <br />funds to Patricia J. Martin. Mr. Lead moved for adt~pption; second by Mr. McKay. Roll <br />Call: Lued, n0; McKay, n0; Mus~al, n0; Nrtr, no; Sarffiger, n0; L12npSrt, n0; Bahas, n0. <br />Motion failed with seven negative votes. Ordinance No. 94-44 is not adopted. <br />Resolution No. 94-93 introducai by Mr. Liad was given its third reading. A resolution <br />authorizing the Director of Public Service to advertise for bids for 3,000 tons of salt and <br />authorizing the Mayor to contract for same, agd declaring an emergency. Mr. Lind moved <br />for adoption; second by Mr. Limpert; motion passed unanimously. Resohnion No. 94-93 <br />adopted. <br />Resolution No. 94-94 introduced by Mrs. Saringer was given its third reading. A <br />resolution accepting for recording .purpose only the Barton Oaks ~.bdivsEOn plat in the <br />City of North Olmsted. Mrs. Saringer moved for adoption; second by Mr. McKay; <br />motion passed unanimously. Resohhrtiion No. 94-94 adopted. <br />Ordinance No. 94-97 introduced by Mr. Lir~ert was given its third reading. An <br />ordinance to amend Secthm 911.08 and 911.09 regarding sewer connections of the <br />Codified Ordinances of the City of North Olmsted, Ohio. Mr. Limpert moved for <br />adoption; second by Mr. Lind; motion passed unanimously. Ordinance No. 94-97 <br />adopted. <br />Ordinance No. 94-98 introduced by Mayor Boyle was given its third reading. An <br />ordinance creating a new Chapter 957 of the Codified Ordinances of the City of North <br />Olmsted entitled "Sale and Contion of Alcoholic Beverages in Public Weaklings and <br />on Public Grounds." Mr. McKay asked the Mayor to read the am~adment to the <br />ordinance. The Mayor said that the amended section would be starting with the last line <br />of the first page with "building" through the colon that appears on the second ~e of the <br />second page. It would read, "beailding, and aone-time basis m North Olm€~ed Munic~al <br />Park in conjunction with the Labor Day celebration to be held on September 3, 1994, <br />sponsored by the Cleveland Federation of Labor AFL-CIO. The Council of the City of <br />North Olnsted may permit the sale and consumption of alcoholic beverages in municipal <br />buildings and on said one occasion provided that:" and then it would continue as written. <br />Since the amendment placed the legislation back to second reading, Mr. McKay moved to <br />suspend the rules requiring three readings on Ordinance 94-98. Law Director Gareau <br />advised that Council would first have to vote to amend the ordinance. Mr. McKay moved <br />to amend Ordinance 94-98; second by Mr. Nashar. Mr. Musial said that he had some <br />great problems with this ordinance as currently established. He does not have a problem <br />with the sale of alcoholic beverages at Springvale or the consumption of alcoholic <br />beverages in the senior citizens center. However, he does have a problem with the sale <br />and consumption of alcoholic beverages in North Olmsted Park. He feels that hosting the <br />7 <br />
