Council Minutes of 6/7/94 <br />7) Moen will hold an official grand opening on Saturday, June 11. The Moen project is <br />the largest economic deve~ment project of the city so far and helped us land the MAC <br />System project. Both pros have brought approximately 450 jobs to the city. <br />8) On June 3, Safety Director Ernie Gandy officially retired. Mr. Gandy served the city <br />for many years as Building Co 'over and then as Safay Director. He has had a <br />positive impact on many ~y departna~ts. He was rasp k for the hiring of two well- <br />qualified engineers, which saves the city mare than $S0,(?00. Ahhough Afir. Gandy will be <br />missed, everyone wishes him good hack in his retirement. <br />Councilman Nashar stated that Mr. Gandy had been of great help to him on numerous <br />occasions, and he would perscmally miss him, <br />Law Director Gareau reported: 1) Working with the Service Director, the city has <br />officially notified a contractor who did concrete work last year that the core samples <br />contaxied contaminated material The city believes that concrete which had been secured <br />from Medina Supply by the contractor is the root of problems on several city streets that <br />were repaved last year. Because the concrete was purcha~d through the contractor, the <br />city has to make a claim against the contractor who will m turn make a claim against the <br />supplier. The city has approximately a half million dollars in street damage that will have <br />to be replaced. <br />2) The Cater case has come to an end with the Supreme Court upholda~g the findings of <br />the lower court. The court found that Mr. Stroh was properly su~ended but not properly <br />discharged simply because there were not a sufficient nurser of elected Council Members <br />who voted on the matter. A crowappeal had bey filed on that issue, but the Supreme <br />Court chose to sidestep that issue and upheld the Charter provision that required atwo- <br />thirds vote of the elected Council Members. The Charter has since been changed to <br />remove the word "elected." <br />3) With regard to the Dancik appropriation case, their attorney has filed an answer. In the <br />answer, they contend that the city did. not have the right nor the need to appropriate the <br />property for senior hous~g. Judge Corrigan has ruled that the city did in fact have the <br />right and the need to do so. The Danciks now have sixty days to obtain an appraisal. A <br />pre-trial has been set for August. ffthe case cannot be settled through negotiations, a jury <br />trial will be held to determine the value of the property. <br />Mayor Boyle reported for Finance Director Bums: 1) Mr. Burns will be on vacation for <br />two weeks. However, he has received a copy of the city's official statement; he will begin <br />the review process so that the notes can be sold next week. <br />Mrs. Beringer, Chairperson of the Building, Zoning and Development Committee, <br />reported: 1) The BZD Committee met on May 26. In attendance were committee <br />members McKay, Nashar, Beringer; Assistant Engineer McDermott; Service Director <br />Bohlmann. The following items were discussed: <br />a. The Barton Oaks subdivision plat, which will be accepted for recording purposes by <br />Resolution 94-94. The subdivision will create 22 sublots. This was approved by Planning <br />2 <br /> <br />
