Council Minutes of 4/19/94 <br />b. Ordinance 94-58, which deals with construction standards and the permit fee for <br />sidewalks. The permit f~ is 530 per 500 square feet of sidewalk, and it should be paid <br />before construction begins. The committee recommended approval. <br />c. The committe=e recommended approval <br />These permit fees have not beset increased since 1989 and they are com~-arable to other <br />We~shore cities. The comtee would like to see these fees adjured annually so the <br />increases do not seem exces~ve. <br />d. Ordinance 94-67, which authorizes the Mayor to enter into an agreement with the <br />Western Reserve Engineerieg snd Surveying Company to provide engineering services for <br />pavement and sewer improvets tin Dolts Drive, .Alden Drive, Wirt Drive, Dewey <br />Road and Sweetbrier Drive (easterly portion). The commaittee recomaxnended passage. <br />e. Resolution 94-69, whit~t authorizes the Service Director to advertise for bids for the <br />videotaping of sewers at varicros locations in the city. This is an on-going project. The <br />committee recommended approval. <br />Mrs. Saringer, Chairperson of the Building, Zoning and Development Committee, <br />reported that Council has authorized Law Director Gareau to hire an appraiser to evaluate <br />the proposed zoning change at Dover Cutter Road and Lorain Road (Sherwin Williams <br />property). <br />Audience Participation <br />Mary Ellen Urmin, 5420 Be~lcshire Drive, was very concerned about the possittiliry of an <br />abortion clinic opening in North Olmsted. As a sidewalk counselor, she has experced <br />first hand the lives of womeat torn apart by abortion. Ms. Urmin does not agree with the <br />statement that we cannot legislate morality because she believes the laws of our nation <br />were based on the Ten Commandments. She would like to see the Mayor, Law Director <br />and Council take some action to prevent an abortion clinic from opening m North <br />Olmsted. <br />Mr. Gareau responded to Ms. Urmin by explaining that he had researched this issue and <br />found that other communities have tried to come up with some unique way to stop <br />abortion clinics from locating in their communities. All attempts have failed. More <br />recently, there has been a trend toward requiring waiting periods and providing readffig <br />material and education. These types of measures have been upheld by the courts. This is <br />one of society's social dilemmas, and it will not be early resolved since the Supreme <br />Court has upheld Roe vs. Wade. <br />The discussion between Ms. Umm~ and Mr. Gareau continued with Ms. Urmin insisting <br />that there must be some way to prevent abortion clinics from locating in our city. Mr. <br />Gareau explained that Council can only act through ordinances and resohttions. <br />Co~~n~es throughout the country have tried various pieces of legislation, including <br />zoning ordinances, and all have been struck down by the courts. <br />5 <br /> <br />
