Council Minutes of 12/S/95 <br />3) Negotiations are continuing on the fir®fighters collective bargaining agreement. <br />4) With regard to the Taylor lawsuit involving an individual who was injured while <br />working at Homeconung, Cammaluity Council's insurance company has made a demand <br />that the city not only defend them but also inde~ify them. We have taken the position <br />that we are not insured to cover Co Council and have instructed them to cover <br />the loss. The Law Dep has requested that .the city insurance counsel file a motion <br />for summary judgment regarding this diap-ute. <br />S) The Recreation Departm~t turned over to the Law Department a clean for $1,120 <br />dealing with the rental of the city pout A defi~ult ' was rendered, and steps are <br />now being taken to seize the assets of the defendant to satisfy the judgment. <br />Finance Director Burns: 1) As previously reported, the budget bill before Congress <br />contained two provisions that wtwltl impact munic~alhies and their employees. The first <br />dealt with Section 457, which is the defexred compensation plan for e~loyees. The <br />assets are currently the property of the pt~litical sub~vis~on anal not the en~loy~s. The <br />conference committee provi~on iacluded a change m this arrangeme$t by provdug for a <br />trust agreement for these plans so that the assets become the property of the employees <br />and not the political subdivision. The second provision that had been con~lered dealt <br />with a mandatory Medicare deduction for all eu~loyees, including those hired before <br />April 1, 1986. This provision was eliminated in the bill that came out of the conference <br />committee. <br />Mr. McKay, member of the Builg, Zoning and Development Comm~ittee, reported on <br />behalf of Chairperson Sar~ger: 1) The committee met on Tuesday, November 29. In <br />attendance were Councilmen Miller, Nashar and McKay; Buildmg Commi~oner Conway; <br />Assistant City Engineer McDermott; Assis~mt Building Coimmssioner Rymarczyk. The <br />following items were discussed: <br />a. Christ the King Church, 30638 Lorain Road. Mr. Robinson and Mr. Schlegelmch <br />presented the plans to construct an addition to the classrooms and the gymnasium. The <br />committee recommended approval. Mr. McKay moved to accept the proposal with the <br />provisions that only one security light will be left on at night over the entrances, 26 <br />parking spaces will be landbanked on the northeast corner of the property along Lorain <br />Road, the ditch will be upgraded with the cooperation of the Engineering Department, the <br />two lots will be consolidated and a maintenance easement for the ditch will be given to the <br />city. Mr. Nashar seconded the motion and it was unanimously passel. <br />b. St. Brendan's Church, 4242 Brendan Lane, proposal for two additions to the school <br />buildmg. Mr. DelGuidice presented the plans for additions on each side of the annex to <br />increase the office areas, cafeteria and storage area. The budding materials will match the <br />existing building. A conditional use permit is required. Mr. McKay moved to approve the <br />proposal and grant the conditional use permit; the motion was seconded by Mr. Nashar <br />and unanimously passed. <br />2 <br />
