Council Minutes of 11/21/95 <br />4) Information provided by the County Planning Commission indicates that North. Olmsted <br />is among the suburbs gaining m population. <br />5) The annual Christmas tree lighting ceremony will take place on Thursday, December 7. <br />Law Director Gareau: 1) Negotiations with regard to the cable TV franchise are <br />continuing. <br />2) Negotiations with the firefighters union have begun. <br />3) The Law Department and i~rsurance counsel are working jointly on the Weissman case <br />which is in federal court. The Law Department intends to file a moticrrr to disrrdss the <br />federal case because remedy is available in the state court system Also, a forfeiture <br />procedure will be filed in Rocky River Court with regard to the confiscated weapon. <br />4) A reply brief in the Hughes case has been received and reviewed. <br />5) An arbitrator has been chosen for an AFSCME grievance case to be heard in 7auuary. <br />6) A motion to dismiss the Grilli case was filed in Rocky River Court. However, an <br />amended complaint was filed over the monetary jurisdiction of $10,000, which means that <br />the case will be transferred to Comm Leas Court. The insurance carrier has been <br />notified since the prayer for relief is in excess of $25,000. <br />Finance Director Burns: 1) The legislation authorizing the temporary appropriation for <br />1996 will be given first reading this evening. The temporary appropriation is essentially <br />one-third of the 1995 appropriation. <br />2) Passage under suspension of the Hiles will be asked for Resohrtion 95-154, which is on <br />second reading. This legislation establishes the property tax rates for 1996 and must be <br />submitted to the County Auditor by December 5. <br />Mr. McKay, Chairperson of the Legislative Committee: 1) The. Legislative/Council-as-a- <br />Whole Committee meeting to discuss proposals from the Charter Review Commission was <br />held on Monday, November 13. In attendance were Council President Boehmer; Council <br />Members Limpert, Lind, McKay, Miller, Musial, Saringer, Nashar; Charter Review <br />Commission Chairperson Dennis Lambert; Finance Director Burns; P & A Director <br />Wilamosky. The following proposed Charter revisions were discussed: <br />a. Article N, Section 6, which would prohibit Council from granting compensation to the <br />boards and commissions. It was noted that in the future Council may wish to reward <br />those individuals who serve the city due to their personal costs. Council voted <br />unanimously to decline this proposed change. <br />b. Article VII, Section 1, Board of Building Code Appeals. The change would require <br />members of this board to be qualified electors and residents of the City of North Ohnated <br />and to serve without compensation. Council voted unanimously to declare this proposal <br />indicating that it was not warranted since all appointments are approved by Council. <br />c. Article VII, Section 4, Board of Zoning Appeals. The change, which would require the <br />members to serve without compensation, was unanimously declined by Council. <br />d. Article VII, Section 6, Landmarks Commission. This change requiring the members to <br />serve without compensation was also declined. <br />2 <br />
