<br />Council Minutes of 10/3/95 <br />had discussions with Ameritech regarding teleconferencing and TV monitors so that <br />prisoners do not actually have to appear in court for arraign~ts. This shod will not <br />only provide more security, but will also save time for police officers who will not have to <br />transport prisoners to the court and back to jail. The WEB mayors will meet tomorrow to <br />discuss this new security program <br />Mrs. Saringer asked Mayor Boyle where senior citizens could submit their names for the <br />new senior housing complex. The Mayor said a previous list had been submhted to the <br />developer, Mr. Coury. However, names can be submitted to him and he will continue to <br />submit them to Mr. Coury. <br />With regard to the Mayor's report on the three new sergeants, Mr. Nashar asked the <br />Mayor for the total number of officers in the Police Department. The Mayor and Mrs. <br />Kesler agreed that the number is currently 54 but will be expanded to 5b, and this will <br />include the two officers finded by the COPS FAST grant and the new DARE officer. The <br />legislation that will be preted to Council will show a complement of 58 to afiow new <br />officers to be added and put into training as other officers are preparing for retirement. <br />At this point in the meeting, the minutes of the Council meeting of September 19, 1995 <br />were approved as written. <br />Law Director Gareau: 1) Since the last Council meeting, three lawsuhs have been filed <br />against the city. The first is Taylor vs. North Ohmsted, which involves a person who <br />incurred a back injury while working at Homecoming. The lift equipt he used had <br />been loaned to Community Council by the city. The Commnmity Council's insurance <br />company offered a low settlement; consequentty, whenthe case was litigated,. the City of <br />North Olmsted was added as a party. The Law Department is currently working with the <br />city insurance company in an effort to have the Community Council insurance company <br />pick up the defense for this case. The agreement between the city and Community Council <br />included an indemnification clause; therefore, the city should not be a party to the lawsuit. <br />2) The second lawsuft, Weissman vs. North Olmsted, was filed by a young man whose gun <br />was confiscated on a concealed weapons charge. After the gun was confiscated, the <br />young man's father reported it stolen to the Elyria Police Department. Mr. Weissman <br />now wants the confiscated gun to be returned, which is not the policy of the North <br />Olmsted Police Department. The attorney for Mr. Weissman has filed a civil rights action, <br />Section 1981, 1983 and 1987, as well as a mandamus. <br />3) The third lawsuit was fiind by the city animal warden, Sam Grilli. Mr. Grilfi claims that <br />the Service Director promised him a certain amount of compensation and that the contract <br />was breached by the city. Article TV, Section 6 of the City Charter provides that: "The <br />Council shall have the power to fix its own compensation and the compensation of each <br />employee of the city." It is clear that only City Council has the authority to set wages. <br />The Law Department will file a motion to dismiss because the lawsuit fails to state a cause <br />of action. <br /> <br />2 <br />
