<br />Council Minutes of 10/3/95 <br />4) Later this week, the Service Director, City Engineer, Malcolm Pirnie Engineer and the <br />Law Director will travel to Columbus for talks with the EPA. <br />5) A pre-trial on the Fox case will be held on Thursday. <br />Mayor Boyle reported for Finance Director Burns: 1) Ordinance 95-136 is on this <br />evening's agenda and it authorizes the transfer and appropriations of fiords for current <br />expenses and other expegditures. This legislation is the result of the Finance Director's <br />discussions with various directors and division leaders. <br />Mr. McKay, Chairperson of the Legislative Committee: 1) The committee met on <br />Monday, September 25. Present at the meeting were Council Members Lied, Mier, <br />Nashar, McKay and Finance Director Burns. The following items were discussed: <br />a. Ordinance 95-117, which requires businesses within 250 feet of a residential structure <br />to post a sign. stating the times that loading/unloadmg and the running of engines are <br />prohibited. The committee recommea~tded approval. <br />b. Ordinance 95-125, which reque~s that an amendment be made to SSB 188 which <br />allows the County Commissioners to levy a tax on all businesses and residents of the <br />county for the benefit of one area. This Legislation asks that, if passed, SSB 188 be <br />amended to include fimding for schools, h'braries, museums and ancillary buildings <br />throughout Cuyahoga County. The committee recommended approval. <br />Mr. Nashar, Chairperson of the Public Safety, Health and Welfare Committee: 1) The <br />committee met on Tuesday, October 3, to discuss a stock transfer for a liquor permit <br />holder in the city. The transfer involved Barry Yee Inc., DBA China House Restaurant, <br />2708'7 Lorain Road. Mr. Nasltar moved. that Council have no objection; second by Mr. <br />Limpert; motion passed unanimously. <br />Mr. Limpert did not have a committee report but wished to comment on the flooding <br />concerns of the West Park-Forest Ridge Civic Association. The residents retained the <br />services of a hydrologist, Dr. DeGroot, who has surveyed the area and come up with some <br />findings. The residents w©uld like to have Dr. DeGroot present his fiadugs at an open <br />forum with Council and the admi~aistration. Mayor Boyle said he felt it would be more <br />productive for Dr. DeGroot and City Engineer Deichmann to meet first and then jointly <br />make a presentation at a later date. Mr, tsareau agreed with the Mayor's a t and <br />said he questioned the wisdom of having a forum He said this is not an issue the people <br />take votes on--it is a problem solving between experts. When projects of this nature are <br />presented to Council, it is on the basis of providing the dollars. It is not to provide the <br />expertise or the knowledge. Once the engineer has made his recommendations, then the <br />public forum can be held to determine the best method of providing the fiords. Mr. <br />Limpert said his reason far bringing this up was to get the best combination of individuals <br />together to provide the most productive solution. Mayor Boyle commented that it would <br />be best for the engineers to meet--this method has worked in the. past. He would be more <br />than happy to release the engineers' findings. Mr. Limpert agreed to carry this message <br />back to the residents. <br />3 <br />
