Council Minutes of 7/S/95 <br />Law Director Gareau: 1) With regard to the Fattlar lawsuit, the insurance company has <br />denied liability on grounds that the lawsuit is framed as a declaratory Jet action <br />which is excluded from coverage. The Law Department has filed and answer and is <br />prepared to defend the city. A motion for summary judgment will probably be filed in <br />August or September. <br />Finance Director Burns: 1) Recently he presented Council with a schedule that shows <br />revenue comparisons between projected anal collected revenues for income taxes and <br />sewer billings. The sewer billing f gores used for comparison are those that were drawn <br />up by Malcolm Pirnie, and those numbers reflected the entire billing at the new rate. <br />However, the Cleveland Water Department prorated the increase so that water usage <br />before April 1 was at the old rate and at the new rate after April 1. <br />2) The Regional Income Tax Agency has made the annual refund to the city on the <br />retainer for processing our income tax co~Ctions. The refiu-d was $171,218. North <br />Olmsted accounts for 4.8% of all transactions at Re~ianal Income Tax and 3.6% of all the <br />dollars collected. Net cost to North Olmsted. after the refimd is 5121,485, or 1.6% of our <br />collections. RITA conducts a yearly program of inspecting apartment buildings to verify <br />that tenants are listed as city taxpayers. Last year this process identified 78 new taxpayers <br />who had not previously resided in a RITA city and 192 indisriduals who had moved from a <br />RITA city to North Olmsted. <br />Mrs. Saringer, Chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met at 6:30 p.m on July S. In attendance were commbttee McKay, <br />Nashar and Saringer and Assistant Engineer McDermott. Agenda items were as follows: <br />a. A water main easement for Cinnamon Woods. The required legislation will be on the <br />agenda at the next Council meeting. <br />b. Sytlm' Concepts, 29919 Lorain Road, a proposal to construct a buiid~g for retail <br />office and warehouse use on a lot adjacent to the existing facility. Owner Mr. Gary Case <br />and neighbors Mr. and Mrs. Benedict were in attendance. A special permit was granted <br />by the Board of Zoning Appeals. The lighting has been addressed, and it has been agreed <br />that a six foot board on board fence will be installed. The Engineering Department has <br />requested a detailed design of the loading dock in order to be sure that there is no <br />interference with the sewer. All other issues were addressed satisfactorily. The BZD <br />Committee did not request that the front canopy be extended. Mr, and Mrs. Be~rexlict <br />were satisfied with the resolution of several items of interest to them. Mrs. Sar~ger <br />moved to approve the special permit and the proposal to construct a bring with the <br />condition that the lot split will be properly pursued and a detailed design of the loading <br />dock be submitted and approved so as not to interfere with the sewer system and with all <br />the recommendations of the Planning Commission; second by Mr. Nasltar; motion passed <br />unanimously. <br />C <br />2 <br />
