Council Minutes of 7/5/95 <br />Mr. Fox wished to pursue the mutter fiuther by complaining that the city has allowed Mr. <br />Simmons to continue working. Law Director Gareau and Mayor Boyle explained that Mr. <br />Simmons' license had been suspended for six months, which is what the law aIlows. The <br />city is required to follow Ohio law. <br />Susan Walker, 5653 Dorothy Drive, complained about the run-down condition of the <br />property at 5658 Dorothy Drive. Mrs. Walker distn'buted pictures of the property. She <br />has complained about this property in the pad. Mr. Mdler said he had infected the <br />property and agreed that the weeds were high. Mr. McKay noted that the city has a high <br />weedlgrass ordinance that can be enforced. Mrs. Walker said that the city has merle the <br />resident cut the weeds several timers, but she feels something needs to be done to make <br />him comply on a regular bans. Mr. Nashar said that he had infected the property several <br />times and knows that there is a problem The Building Department is currently m the <br />process are hiring two inspectors. Once these people are in place, the property <br />maintenance ordinance will be passed. Mr. Gareau commente.tl that he had previously <br />suggested that the ordinance be pas~i so that shuations like this could be handled <br />through the Prosecutor's office. Mr. Nashar stated that the Safely Director and B <br />Commissioner feared that passing the ordinance would open a `~oodgate of complaints," <br />which the Building Department could not handle because it is understaffed. Mr. Gareau <br />said that the complaints would have to be prioritized. <br />Beverly Schultz, 5674 Dorothy Drive, also complained about the run-down conditi~ of <br />the property at 5658 Dorothy Drive, which is next door to her home. Mrs. Schuhz asked <br />when the property maintenance code would be passed, and Mr. Nashar replied that he <br />hoped it could be passed at the second meeting in August. Mayor Boyle sugge~ed that <br />Council amend the agenda to add the legislation and pass it this evening. Mrs. Saringer <br />agreed to take the legislation out of committee and moved to amend the agenda to incinde <br />Ordinance No. 95-33. The motion was seconded by Mr. Nashar and passed unanimously. <br />It was then determined that the legislation did not inchule an emergency clause. Mrs. <br />Saringer agreed that during the Legislative portion of the meeting she would move to <br />amend the legislation to inchtde an em~xgency clause so that it could go into effect upon <br />the signature of the Mayor. After amendment, the legislation would then be passed under <br />suspension of the rules. <br />Chuck Lee, 24036 LeBern Drive, expressed concern about flooding at his home because <br />there is across-connection between the storm and sanitary sewers. He is not looking for <br />any compensation or damages, but he wants the problem fixed. Mr. Gareau and Mayor <br />Boyle explained that not every cross-connection is the responst~ility of the city. The <br />Engineering Department will have to examine his property to determine responsibility. <br />Joyce Murphy, 4245 Phunwood Drive, said that her basement had recezttly flooded for the <br />third time in six and a half years. She said that her insurance premiums are increasing <br />because of the claims she has had to make. Mayor Boyle explained that the city has spent <br />approximately $15 million in the last five years to correct flooding problems in .the city. <br />The city will continue working to correct these problems.
