Council Minutes of 5/16/95 <br />asked the developer to consider having access onto Lorain Road due to the fact that <br />~~- <br />,~¢: vehicles akeady have a difficult time pulling out from the side street onto Clague Road. <br />Mrs. Saringer moved to approve the preliminary plan for Bridgeport Village subdivision; <br />second by Mr. Nashar. (Per a request, the following is a verbatim transcript of discussion <br />regarding the Bridgeport Village subdivision:) "Mr. McKay: Before the roll call, Mr. <br />President, may I make a statement? Mr. Boehmer: Yes. Mr. McKay: The concept plan <br />that was submitted by the developer meets all of the requirements of the Zoning Code in <br />the City of North Olmsted. I think that you're well aware that once he does that, the city <br />has no recourse but to grant that proposal. If they don't, they, Mike will probably be in <br />for you. Thank you. Mr. Boehmer: Thank you. May we have the roll call please? Roll <br />call: Saringer, no; Nashar, yes; Musial,... Mr. Musial: Question, Mr. Gareau, do you <br />concur with Mr. McKay's statement? Mr. Gareau: This is the... Mrs. Saringer: <br />Whitlach. Mr. Gareau: ...the subdivision that's by West Two Hundred and... Mr. Lind: <br />Thirty-first. Mr. Gareau: I think it would be irresponsible to vote against it. When we <br />take an oath of office, the oath of office says that, if they comply with the Code, that <br />they're entitled to receive approval. I've issued an opinion to that effect. They do meet <br />the provisions of the Code, and to vote against it would fly in the face of the ordinances of <br />the city and your oath of office. Mrs. Saringer: Mr. President, although there is a motion <br />on the floor, but evidently it's not being .adhered to, I would like to just say that there <br />were a lot of unanswered questions and whether they do meet the criteria, the Code, <br />because there were questions about retentions and wetlands. Mr. Gareau: Mrs. Saringer, <br />that does, you know that this is a preliminary approval... Mrs. Beringer: I know. Mr. <br />Gareau: ...for subdivision only and those issues are not addressed at this point. So, that is <br />not a reason to vote this proposal down. Mr. Boehmer: Go on with the roll call, please. <br />Roll call continued: Musial,... Mr. Musial: May I hear the vote call to date? Mr. <br />Boehmer: One and one. Clerk: Mrs. Saringer voted no and Mr. Nashar voted yes. Roll <br />call continued: Musial, yes; Miller, no; McKay, yes; Lmd, yes; Limpert, yes." The motion <br />was approved with five affirmative votes and two negative votes. <br />h. The proposed property maintenance code was discussed. The Building Commiccioner <br />and Safety Director again expressed concern about the lack of personnel to carry out <br />enforcement of this legislation. The Building Department needs to fill the positions of <br />Chief Inspector, Building Inspector, part-time Maintenance Infector and Secretary II. <br />The committee agreed to hold the legislation for the present. <br />Mr. McKay, Chairperson of the Intra-Governmental Relations, Legislation and Long- <br />Range Planning Committee: I) The committee met on Monday, May 8, and present were <br />committee members Lind, Musial and McKay. Also in attendance were Council Members <br />Limpert, Miller and Nashar; Safety Director Kesler; Service Director Bohlmann; Fire <br />Chief Osterhouse; residents John Kennedy, Carl Kessler and Margaret McKay; reporters <br />Jacgi Templeton and Julie Sowa. The following agenda items were discussed: <br />a. A request to name the new fire station in memory of former Fire Chief Ray Bement. <br />After some discussion, Mr. Kennedy and Mr. Kessler suggested a wall plaque in the <br />entrance hall of the fire station.
