In addition, Springvale is not administered under the Recreation Commission <br />but is under the Safety Director's control. It is not a Recreation facility but rather a <br />recreational revenue-source facility. <br />3) Firefighter Ed Bak is thanked for taking it upon himself to apply for training grants for <br />the Fire Department. Because of his efforts, the city will receive $6,850 for firefighter <br />training and $6,494 for training of the hazardous material team. <br />Law Director Gareau: 1) Several months ago, he informed Council that a complaint was <br />filed with the Ohio Civil Rights Commission regarding the limitations in the city <br />application for original appointment to the Fire Department. The Ohio Civil Rights <br />Commission has issued an opinion that the individual has the right to sue and there is <br />probable cause. The Ohio Revised Code provides that original appointments in municipal <br />corporations cannot go beyond the age of 30. However, if a local municipality designates <br />a specific age, they can go up to age 35. Up until two years ago, Title 7 of the U. S. Code <br />exempted municipal corporations from age discrimination for police and fire. A bill is <br />currently pending in the U. S. Senate to reinstate the provision in Title 7 that exempts <br />municipal corporations. Consequently, we are currently in a "window" where we have to <br />deal with this problem of discrimination with respect to age for original appointments to <br />police and fire. The Law Department is working on the issue and endeavoring to seek <br />some resolution. <br />2) He is in the process of preparing a brief for the police grievance dealing with uniform <br />allowance. <br />3) Recently, a deposition of former Animal Warden Sam Grilli was taken. The Law <br />Department is working with the insurance company and their attorney to come up with <br />despositive motions regarding this case. <br />Finance Director Burns: 1) The final draft of the city investment policy is now at counsel. <br />He anticipates that the final draft will be ready for presentation to City Council at the next <br />Council meeting. <br />2) He had expected the 1993 and 1994 audits to be released in mid-September. However, <br />within that report was a citation to which he had taken an opposite position to that of the <br />Auditor of State. The issue was sent to Columbus for review. Subsequent to the draft of <br />the report being released from the Auditor of State's office, bond counsel reviewed the <br />report and determined that the Finance Director was correct. The issue was taken up with <br />the Legal Department of the Auditor of State's office, and it has been decided in favor of <br />the Finance Director. The report is now being rewritten, and it is anticipated that the <br />audits for 1993 and 1994 will be released within the next week. <br />Mr. Nashar, Chairperson of the Public Safety, Health and Welfare Committee, commented <br />on the on-going traffic signalization program. There are two problem areas that are being <br />addressed as the traffic signalization system is being installed. One, is the intersection of <br />Great Northern Boulevard and I-480 where the traffic backs up in the morning and <br />evening hours. The city is doing its best to get this traffic moving especially before the <br />~; Christmas holidays arrive.
