Council Minutes of 9/17/96 <br />expand and to lure businesses, and thus jobs and stable tax bases, into this region. As an <br />example, this would mean that a city such as Bay Village that does not have much <br />developable land but has a large bonding capacity can join with a city such as North <br />Olmsted to develop properties, thus securing our tax bases. <br />4) Last night a meeting was held with residents to discuss the Mill Road project. Some of <br />the comments and suggestions that were made may be incorporated into the project. <br />Hopefully, further discussions on this issue will be held. <br />5) The Town Hall meeting will be tomorrow at 7:30 p.m. at Pine Elementary School. <br />Everyone is welcome to attend. <br />Law Director Gareau: 1) He has filed on behalf of the city a declaratory judgment action <br />against AFSCME and two of its members regarding a dispute that arose when the two <br />employees were denied coverage under the dental plan. After the employees had appealed <br />their denial through J. P. Farley, they then filed a grievance which he feels is inappropriate <br />because of the city's contractual obligations with J. P. Farley to review claims and do pre- <br />certification. If this grievance were allowed to go to the arbitration stage which is binding, <br />that would put the arbitrator in the position of becoming the super designator of who is <br />covered and who is not covered under the city hospitalization plan. Because he does not <br />believe this is an arbitable issue, he has asked the court to make a determination on the <br />contractual rights, duties and obligations of the parties involved in this dispute. <br />2) As the Mayor mentioned, the city has met with Fairview Park to discuss the Georgette <br />relief sewer project. In April, Council authorized the Mayor to apply to the Ohio Water <br />Development Authority and the EPA to obtain a grant for this project. It was determined <br />that the City of North Olmsted would be the Lead city in this project and would have the <br />responsibility for repayment. North Olmsted would then make an agreement with <br />Fairview Park to pay their share of the cost. Those items were all in place and what <br />needed to be done in order to meet and lock in on a favorable loan rate was to write a <br />legal opinion with respect to the city's rights to bind itself in such a manner. Also, the <br />application, contract and loan documents had to be approved. That work has now been <br />completed, 30 days ahead of schedule, and has been submitted. Hopefully, the project wilt <br />begin 30 days earlier than had been anticipated. <br />3) The Engineering Department has advised that there are still a number of residents who <br />have failed to remove cross-connections and infiltration points with the sanitary sewer <br />system. This week letters will be sent to fourteen residents advising them that they have <br />30 days within which to disconnect or repair. If they fail to do so, we will join them all <br />into one lawsuit to be filed in Common Pleas Court asking for injunctive relief and <br />damages. <br />4) An answer in the Fattlar case has been filed in the Court of Appeals. <br />5) Last week an arbitration hearing was held regarding the yearly uniform allowance for a <br />police officer who resigned on January 3, 1996. The officer asked for the entire year's <br />allowance even though he was not afull-time employee at the time of the first payday, <br />January 12, 1996. <br /> <br />2 <br /> <br />
