Council Minutes of 8/20/96 <br />. O'Grady. Mr. McKay commented that the ordinance was not brought to the Etoor of <br />„~~. Council with the intention of degrading the Board of Zoning Appeals by their past <br />performance or any member of the Board of Zorvng Appeals. It appears that seems to be <br />the consensus. The reason this was brought up was because a number of Councilmen felt <br />that the gravity of the granting of use variances should be addressed by elected officials <br />rather than by appointed oicials. Mr. O'Grady agreed with Mr. McKay's and said there <br />was a problem here with perception not with any reality of what was stated in that <br />ordinance. The ordinance was not bringing into question any instance of abuse by any <br />member of any board or commission of the city. It was not a question of trust or <br />capability or intelligence. It was not a question of resident access to the appellate process <br />or Council's agreeing or disagreeing with any decision of the board or commission. It was <br />simply an effort by Council to live up to Council's responsibility to the citizens of this <br />community to insure that the authority to make any changes rests with elected officials <br />who are answerable to the citizens of the city. He expressed his appreciation and thanked <br />the people who do so well and volunteer their time and serve our city on the boards and <br />commissions. The motion passed unanimously. Ordinance No. 96-99 was removed from <br />the agenda. <br />Ordinance No. 96-110, introduced by the Mayor and entire Council. An ordinance <br />approving a new sewer service agreement between the City of North Olmsted and the City <br />of Fairview Park under which a portion of the City of Fairview Park is served by the city's <br />sanitary sewer system modifying the existing agreement, authorizing the execution of the <br />new agreement, as amended and declaring an emergency. Mr. Lind moved to removed <br />Ordinance No. 96-110 from the agenda; second by Mr. McKay; motion passed <br />unanimously. Ordinance No. 96-110 was removed from the agenda. <br />Ordinance No. 96-88, introduced by Mayor Boyle. An ordinance renewing the non- <br />exclusive franchise agreement between the City of North Olmsted and Cablevision <br />Systems Corporation, granting it the right to construct, operate and maintain a cable <br />system for the purpose of transmitting, receiving, amplifying and distributing analog and <br />digital, television, radio, data signals and for any other purpose permitted by law by the <br />City of North Olmsted for a fifteen (15) year period, as amended. Mr. O'Grady moved to <br />remove Ordinance No. 96-88 from the agenda; second by Mr. Limpert; motion passed <br />unanimously. Ordinance No. 96-88 was removed from the agenda. <br />Ordinance No. 96-107 introduced by Mayor Boyle was given its second reading. An <br />ordinance accepting for dedication as part of the right-of--way along Mill Road certain <br />property owned by Water Tower Square Limited Partnership, and declaring an <br />emergency. <br />Ordinance No. 96-108 introduced by Mayor Boyle was given its second reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into various <br />agreements with Angelo and Denise Papotto, Jr.; Ida Juhasz; Dominic and Angela <br />Pishnery; and Alan R. and Pauline Kaserman, to purchase and/or to exchange property, all <br />in connection with the improvement of Mill Road, and declaring an emergency. <br />7 <br />t <br />
