Council Minutes of 3/20/96 <br />would be on the property, one recorded and one implied; approximately twenty to twenty- <br />-<~ eight percent of the property would be under easement. The Kauffman's lending <br />institution, the title company's legal department and an appraisal company do not accept <br />the existing pipe underneath the dwelling. The St. Claire Appraisal Company evahiated <br />the property in February 1994 and listed concerns of potential loss of value, loss of utility <br />surface land, loss of potential building sites and inadequate sewer capacity. The existing <br />sewer system carries roof and gutter runoff water underneath the home causing a potential <br />for underground erosion. <br />Dennis Lambert, 25057 Carey Lane, spoke about Council's request that the Mayor submit <br />appropriations in a line item format. Mr. Lambert disputes the Law Director's opinion <br />that the Mayor need not give the appropriations in the format requested by Council. He <br />said that Council does not need an opinion from the Law Director to determine whether <br />appropriations are going to be given or not because Council has the final vote on whether <br />money is spent. Mr. Lambert said he would "like to see the Council grow from a reactive <br />Council to a proactive Council and, together in partnership with the administration, work <br />toward the betterment of the city." <br />In response to Mr. Lambert's comments, Law Director Gareau quoted sections of the <br />Charter which indicate that the appropriations are submitted by the Mayor in the format <br />that he desires. However, Council does have the ultimate authority and may make any <br />revisions to the appropriations legislation that they deem proper. Mayor Boyle <br />commented that he was concerned about Mr. Lambert's comment that the Council should <br />be more proactive than reactive. He feels the Council is proactive. With regard to the <br />appropriations, he has discussed this with several Council Members.. He is submitting the <br />appropriations the way it has been done in the past because he believes it is the best way <br />to appropriate. However, within that presentation there will be a worksheet that will <br />break the budget down into finer details. Council does, in fact, know where money is <br />being spent and has always had access to the worksheet. The worksheet will now be <br />included as part of the legislation, which will make it accessible to everyone. <br />Mr. McKay asked Service Director Bohlmann to comment on the Kaugman's problem. <br />Mr. Bohlmann said that over the past two years the city has attempted to come to an <br />agreement with the Kauffmans. Although an agreement on the Kauffman's list of 17 items <br />has not been achieved, the city has invested several thousand dollars in engineering <br />services to correct the problem. The city has not ignored the problem Mr. Bohlmann <br />concurs with Mrs. Kauffman that part of her home should not be in the easement. The <br />storm sewer initiates on the west side of Porter Road, just a few hundred feet south of <br />Mill and Porter, and then continues open ditch to the back of the Kauffman property <br />where it runs into culvert pipe and goes underneath the south corner of the home. Since <br />the initial meetings with the Kauffman's, the city has received an Issue 2 grant for the <br />reconstruction of Mill Road and the signalization of the Mill-Porter Roads and the <br />expansion of the fuming lanes. When the drainage for Mill-Porter Roads is designed, the <br />water that drains through the storm sewer in the Kauffman property will be removed. <br />This will eliminate a good deal of water that would normally go through that storm sewer, <br />6 <br /> <br />
