Council Minutes of 3120/96 <br />which is old, and will instead be redirected down North Park Drive. At this point, there is <br />no resolution with the Kauffmans as to what the city will be responsible for with regard to <br />their list of 17 demands, which include such items as backyard drainage, shrubbery and <br />grass concerns. <br />Mr. Limpert commented that he has discussed the Kauffman's problem in detail with Mr. <br />Bohlmann and would like to "get things moving." Mr. Limpert noted that the reason this <br />situation developed was that the city sewer was installed without easements many years <br />ago when the property was a vacant orchard. The home was built over it without the <br />builders being aware of the sewer, and the home has sold several times because banks <br />were not aware that a sewer ran underneath. Now that the Kauffman's bank is aware of <br />the sewer, they have a major problem with financing an addition or even selling the home. <br />Mr. Bohlmann said he did not believe the sewer ran underneath the original home--the <br />dwelling has been expanded over time. The problem came to light when the Kauflman's <br />decided to add a second flood addition to the section of the home above the storm sewer. <br />The Building Department would not allow the addition because they were concerned <br />about the integrity of the footer and the weight of the dwelling on top of the storm sewer. <br />Mrs. Kauffman said that St. Claire Appraisal Company had determined that at one point <br />an open ditch ran through the property and there was a tool shed attached to the house <br />which was not to be a garage. One of the next three owners built atwo-car attached <br />garage without the proper permits. The footers are not sufficient, and the Kauffman's <br />have noted a four inch drop in their patio below the concrete slab of the home. Mr. <br />McKay, Chairperson of the Streets & Drainage Committee, requested that Mr. Bohlmann <br />and the City Engineer meet with him to discuss the Kauflman's situation. Councilman <br />Limpert and the Kauffmans will also attend the meeting. <br />LEGISLATION <br />Resolution No. 96-37 introduced by Mr. McKay was given its third reading. A resolution <br />authorizing the Director of Public Service to advertise for bids for the purchase of sewer <br />flow meters as detailed in the specifications on file and authorizing the Mayor to contract <br />for the same, and declaring an emergency. Mr. McKay moved for adoption; second by <br />Mr. Nashar; motion passed unanimously. Resolution No. 96-37 adopted. <br />Ordinance No. 96-40 introduced by Mayor Boyle was given its third reading. An <br />ordinance authorizing and directing the Mayor of the City of North Olmsted to enter into <br />an agreement with Malcolm Pirnie, Inc. to provide engineering services pertaining to the <br />biological monitoring requirements of the 1995 NPDES permit as required by the Ohio <br />EPA and declaring an emergency. Mr. McKay moved for adoption; second by Mr. Lind; <br />motion passed unanimously. Ordinance No. 96-40 adopted. <br />Ordinance No. 96-41 introduced by Mayor Boyle was given its third reading. An <br />ordinance authorizing and directing the Mayor of the City of North Olmsted to enter into <br />an agreement with Dennis A. Seifert & Associates, Inc. to provide engineering services <br />pertaining to drainage improvements for the Woodside-Deepwoods area and the Duane <br />7 <br /> <br />
