Council Minutes of 3/5196 <br />Carole Almady, 3688 Dawn Drive, said her concern was that the adult entertainment <br />business would locate in other areas of North Olmsted such as the math Law Director <br />Gareau explained that the city cannot legally exclude adult entertainment businesses. This <br />is a freedom of expression issue which is covered by the First Amendment. <br />Margie Metzger spoke again asking about hours of operation and signage, especially <br />flashing neon lights. Mr. Gareau explained that the State regulates hours of operation for <br />bars. As to signs and lights, these issues are covered in our Zoning Code. <br />Patty Chakarelis wanted assurance that the adult entertainment business could not open on <br />the Darby O'Tooles' site once the legislation is passed. Mr. Gareau confirmed that an <br />adult entertainment business would not be able to open on that particular property. The <br />legislation requires such businesses to be licensed, and that property would not fit within <br />the licensing provisions because it is too close to residences. <br />J. T. Mullen, 4280 Plumwood, asked the Law Director whether he felt this approach will <br />work. Also, he wanted assurances that the city is committed to fighting this problem and <br />will be able to come up with the resources to fight the case. Mr. Gareau said he was <br />convinced that this method is the correct way to fight the problem, Mayor Boyle <br />commented that the city is committed to regulate this form of business in general--not just <br />this one particular establishment. The city will do everything possible within the law to <br />regulate these businesses. <br />Cecelia Healy, 4269 Plumwood Drive, asked if here street was going to be paved this <br />year. Mr. Bohlmann answered that the city will do a major slab repair program in the <br />Phunwood-Bentley area this year. Mr. McKay commented that the residents should <br />understand that the project is not a complete street replacement. It will be slab repair <br />where pieces of cement that are in bad shape will be removed and replaced. <br />Mayor Boyle suggested that anyone having a petition should give it to the Safety Director <br />who was at the back of the room. Also, anyone who might have further comments can <br />send them to him at City Hall. <br />LEGISLATION <br />Ordinance No. 96-23 introduced by Mayor Boyle was given its third reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into an agreement <br />with Western Reserve Engineering & Surveying Co. to provide engineering services for <br />the inspection and evaluation of sanitary manholes in the area tributary to the LeBern Lift <br />Station and declaring an emergency.
