The rezoning would stop the continued <br />commercialization of that area, especially with the plans of neighboring North Ridgeville. <br />4) An executive session is requested this evening to discuss contract negotiations. <br />Law Director: 1) Assistant Law Director Dubelko and Building Commissioner Conway <br />traveled to Akron for a hearing before the Ohio Board of Building Code Appeals <br />regarding the Moran case. A decision has not been rendered. Mr. Moran is requesting <br />that a proposed building code that will go into effect two years from now be implemented <br />now. At the same time, he is asking for a variance from that building code with regard to <br />sprinkling and/or emergency access on the third floor of his building. <br />2) NOMBL negotiations were scheduled today, but no conclusions were reached. The <br />negotiations will be discussed in the executive session requested by the Mayor. <br />3) The Fattlar grievance was filed in the Supreme Court last Thursday. <br />4) A Civil Service hearing was held to remove a candidate third on the list because of a <br />background check. The Civil Service Commission will make a ruling on this matter soon. <br />5) An arbitration hearing was held in the firefighter's valor pay case. Briefs in the case are <br />due at the end of January. <br />6) Assistant Law Director Dubelko attended a hearing today in Rocky River Municipal <br />Court regarding the city's case dealing with Parcel E. The landowner was charged with a <br />violation of the urban forest ordinance relating to the removal of certain trees. The judge <br />has withheld a ruling that case. There are other cases pending and it seems like everybody <br />is waiting for the other person to act first. Consequently, we do not have the ruling in this <br />criminal case. <br />Finance Director Burns: 1) The city has received applications for the HEAP Program, and <br />they are available in the lobby or through the Human Resources Department. <br />2) On second reading tonight is Ordinance No. 97-117, which is a transfer ordinance for <br />1997. Since it has been to committee, he is requesting passage under suspension of the <br />rule. <br />3) Although this is his last meeting as Finance Director, he has committed to the new <br />administration to follow through with a number of pending items. These projects are as <br />follows: <br />• The Rocky River vs. the City of North Olmsted lawsuit involving the payment of <br />allocated expenses for the calendar year 1996. <br />• The action to recover by Cuyahoga County on the hoteUmotel tax for 1991 through <br />1997. <br />• Fairview Park capital agreement. This involves Fairview Park's share of the cost for <br />the Georgette project and their cost for the renovation of the Wastewater Treatment <br />Plant. Those projects were completed this year, and we now have final figures that <br />can be submitted to Fairview Park. <br />• Pending items involving NOMBL and RTA that will need to be resolved within the <br />next month or two. <br />• A major income tax assessment. He will be meeting with Ms. Copfer to inform her of <br />the facts and will assist her on the logic and theory behind what was done. <br />2 <br />..
