Council Minutes of 12/16/97 <br />4) In addition to the above and as a caution to Council, there are a couple of issues that <br />they might want to keep in mind as they progress: As the city has done its construction <br />projects and debt program to fund those projects, things have been put in place that need <br />to be continued for the next few years. Even though our available debt limit now is <br />$15 million, we are restricted on what money is available from the General Fund. That <br />needs to be looked at as opposed to the debt limit itself when considering any additional <br />borrowings. Also the sewer rates were projected to last the city through the year 2000. <br />Keeping in mind that the Sewer Fund may currently create a substantial fund balance, part <br />of that will be eaten up by cost of living increases and payroll or other increases in costs <br />while the rates will not be changing but will remain constant. <br />Mr. Nashar asked whether the figure we owe the county for the hoteUmotel tax had been <br />finalized. Mr. Burns said it had not been finalized. We have not heard from the county <br />since he and Law Director Gareau met with them. Law Director Gareau stated that, <br />because of the Statue of Limitations, the figure changes daily. <br />Mr. Musial, Chairperson of the Building, Zoning and Development Committee: 1) 1) The <br />Committee met on December 9, 1997. Present were Council Members McKay, Nashar, <br />Musial, Lind and Limpert; Law Director Gareau; Building Commissioner Dave Conway; <br />Assistant Engineer Dave McDermott; Police Chief Frank Viola; Finance Director Jim <br />Burns; Safety Director Carolyn Kasler; Ward II Councilperson-elect Michael Gareau Jr.; <br />Finance Director-elect Carrie Copfer. The following items were discussed: <br />a. A request by Horizon Child Care facility for a conditional use permit at 23675 Lorain <br />Road at David Drive, P. P. 237-5-3 and 237-7-18 to allow operation of a day care facility <br />in a General Business District. Representing Horizon were Brian Grassi, architect, and <br />Shannon Smith, special project consultant. This request is for a conditional use only in <br />this area. The building plans will come back before the Planning Commission. The <br />Planning Commission approved this request on November 25, 1997. Mr. Musial moved <br />that the request of Horizon Child Care Facility be approved; second by Mr. McKay; <br />motion unanimously passed. <br />b. A concern raised by Building Commissioner Conway. Several developers approached <br />the city concerning elderly housing or assisted living facilities. It appears that we have a <br />situation wherein single family, two family, cluster homes and as a conditional use, <br />hospitals, nursing homes, institutions for children and the aged are all permitted in the <br />multiple residence district, but there is no specific mention of elderly housing or assisted <br />living facilities. The question then seems to become as to the interpretation as to what is <br />permitted by the statement of "institutions for the aged". The BZD committee requested <br />our law director to look into the subject and to draft an ordinance to correct any confusion <br />as to specific regulations for institutional uses for the aged and to include senior residences <br />uses into one and two-family residence districts, multiple-resident districts and business <br />districts. An ordinance reflecting these changes is represented by Ordinance No. 97-121 <br />which is on first reading tonight. <br />3 <br /> <br />
