Council Minutes of 12/2/97 <br />2) Regarding the Moran case, a hearing will soon be held before the State of Ohio Board <br />,~. <br />;,,~;, of Building Appeals. Assistant Law Director Dubelko and Building Commissioner <br />Conway will represent the city. <br />3) Regarding Parcel E, he has met with the planning expert and presented him with all <br />pertinent information. <br />4) Some months ago, two AFSCME employees filed for certification with J. P. Farley to <br />have dental work done. The requests were denied. Instead of appealing through the court <br />system, the employees filed a grievance. The Law Department filed for a declaratory <br />judgment in Common Pleas Court and also asked that the employees be restrained from <br />proceeding through the arbitration process. The employees filed a declaratory judgment <br />action indicating that the matter should be arbitrated. The Common Pleas court has ruled <br />in the city's favor that the matter is not arbitable. <br />5) The FOP has requested that Council approve an extension of the time that the fact- <br />finder must report to SERB with respect to the contract which expires on January 1. <br />Council must vote to agree to the extension and to make negotiated wages retroactive to <br />January 1. <br />6) The city met with officials from the City of Westlake to discuss the Hall Ditch. North <br />Olmsted has two 30-inch pipes going into Westlake, which only has a 20-inch pipe that is <br />completely blocked. It was a very productive meeting, and the Westlake officials were <br />very responsive to our needs. We have been informed that in the Spring Westlake will <br />either clean out or replace their pipe. This will give much needed relief to the Deerfield <br />subdivision. <br />7) This Thursday, an arbitration will be held with respect to a firefighters' union issue <br />dealing with valor pay. A firefighter who was injured moving a ladder during a fire filed <br />for valor pay. The request was turned down by the Safety Director, and the matter is now <br />before an arbitrator. This is very similar to the Police Department case. <br />Finance Director Burns: 1) The $100,000 rollover notes for the rescue squad were sold <br />today for 4.40%. <br />2) On tonight's agenda is Ordinance 97-117, a transfer ordinance for 1997. A detailed <br />worksheet will be available to Council at a later date. <br />Mr. McKay, Chairperson of the Streets & Drainage Committee: 1) The committee met in <br />joint session with the Finance Committee on Monday, November 24. Present were <br />committee members Lind, Musial, Nashar and McKay; Safety Director Kasler; Finance <br />Director Burns; Finance Director-elect Copfer; Councilman-elect Gaxeau. The committee <br />discussed Ordinance 97-104 which authorizes the city to cooperate with the county in the <br />repair and resurfacing of Barton Road from the county west line to Lorain Road. The <br />county will prepare the plans, specifications and engineering standards and will provide <br />supervision and administration. of the contract. The city will contribute 20% of the <br />construction costs and 40% of the cost of the plans. Earlier this evening, Service Director <br />Bohlmann provided cost figures to the committee: cost to the city will be approximately <br />$31,700. Upon completion of the work, the city will be responsible for maintenance and <br />upkeep.
