Council Minutes of 9/16/97 <br />building on secondhand dealers' property. The legislation requires that all donations be <br />made inside the place of business. Drop-offs outside of the building will no longer be <br />allowed because it is unsightly and creates a nuisance for nearby residents. The committee <br />recommended approval. <br />AUDIENCE PARTICIPATION <br />Thomas Gallagher, 6853 Chadbourne Drive, is concerned because a cable company plans <br />to dig 21 feet from the street curb utility easement on his property. He contends that the <br />easement was granted to the East Ohio Gas Company and is for 10 feet. Mr. Gallagher <br />said that his property had been dug up five previous times, and he has had to replace his <br />lawn each time. Mr. Gallagher stated that a cable company is not a utility and that the <br />easement is not the city's to give because an easement stems from the landowner. Mr. <br />Gallagher feels his Constitutional rights are being violated. In order to protect his rights <br />and his land, he is taking an "open, notorious and hostile" action by placing a "No <br />Trespassing" sign on his property. Mayor Boyle said that he and the Law Director would <br />discuss Mr. Gallagher's situation. <br />LEGISLATION <br />Resolution No. 97-72 introduced by Mayor Boyle was given its third reading. A <br />resolution authorizing the Mayor to submit and seek financial assistance from the State <br />Issue 2 Infrastructure Bond Program for funding of various municipal capital <br />infrastructure improvements projects, and declaring an emergency as amended. Mr. Lind <br />moved for adoption; second by Mr. McKay; motion passed unanimously. Resolution <br />No. 97-72 adopted. <br />Ordinance No. 97-44 introduced by Mr. McKay was given its second reading. An <br />ordinance adopting a new and revised Section 521.14 entitled "Treelawn and Apron <br />Maintenance" in Chapter 521 entitled "Health, Safety and Sanitation" of the Codified <br />Ordinances of the City of North Olmsted, Ohio. <br />Ordinance No. 97-71 introduced by Mr. McKay on behalf of Mrs. Saringer was given its <br />second reading. An ordinance amending Sections 755.11 and 755.12 of Chapter 755 of <br />the Business Regulation Code of the City of North Olmsted, entitled "Secondhand <br />Dealers," in order to further regulate unattended donations made to secondhand dealers, <br />and further creating a new Section 521.15 of the General Offenses Code of the City of <br />North Olmsted to provide misdemeanor penalties against individuals who leave donated <br />materials on sidewalks, in parking areas, or otherwise outside of buildings of secondhand <br />dealers. <br />Ordinance No. 97-74 introduced by Mayor Boyle was given its second reading. An <br />ordinance designating a percentage of revenues derived from the lease of city property for <br />commercial antenna sites to the city's Economic Development Fund, as twice amended, <br />and declaring an emergency. <br />5 <br /> <br />
