The motion <br />passed with five affirmative votes and two negative votes. <br />Mr. O'Grady did not have a committee report but wished to comment on Ohio Senate <br />Bill 35 regarding changes to the law concerning drivers' licenses for juveniles. Key points <br />of the bill are as follows: <br />• Authorizes the issuance of a temporary instruction permit to persons who are at least <br />15 1/2 years of age, provided in addition to other restrictions, that the person is <br />accompanied by a parent, guardian or driving instructor while operating a motor <br />vehicle. <br />• Prohibits the holder of a temporary instruction permit who is a minor or the holder of <br />a probationary driver's license from operating a motor vehicle between the hours of <br />midnight and 5 a. m. <br />• Requires a person who is issued a probationary license to have held a temporary <br />instruction permit for at least six months. <br />• Reduces from three in a two-year period to two in a two-year period the number of <br />moving violations that a holder of a temporary permit or probationary driver's license <br />can have prior to having their license suspended. <br />• Requires a person who is issued a temporary instruction permit on or after age 16 to <br />be accompanied while operating a motor vehicle by a licensed operator who is at least <br />21 years of age. <br />• Prohibits the operation of a motor vehicle by a person holding a temporary instruction <br />permit or a probationary driver's license unless all occupants of the vehicle are <br />wearing the available seat belts. <br />Mr. O'Grady feels that these are very common sense changes. The bill has passed the <br />Senate and is being sent to the House of Representatives. The proposed changes will go <br />into effect July 1, 1997. <br />AUDIENCE PARTICIPATION <br />Joyce Weber, 5737 Allendale Lane, spoke about her continuing concern over the flooding <br />problems in the Allendale/Carey neighborhood. Mrs. Weber showed a picture of her <br />property during a flood and asked how members of the administration and Council would <br />look at each line of the budget if it was their home being flooded. The flooding problem, <br />which Mrs. Weber and her neighbors feel was caused by the building of the Butternut <br />Ridge Apartments, has caused much grief. Time after time they have patiently awaited <br />funding for this project. They need help, and they are very concerned because it is spring <br />and the spring/summer rains will be coming. Mayor Boyle replied that he could not give <br />an answer about funding at this time since the city is still in the appropriations process. <br />Allendale/Carey, and other areas that flood, are of prime concern to the administration and <br />Council. We have proven that we are trying to address flooding problems, and we will <br />address the Allendale/Carey problem. The engineering for the Allendale/Carey project is <br />5 <br />
