Council Minutes of 3/4/97 <br />4) TV station Channel 43 conducted a survey concerning shopping areas and Great <br />Northern Mall was voted the best shopping center in the area. Although there has been <br />discussion that North Olmsted is losing its position as a retail area, this survey proves we <br />are still recognized as a retail area. <br />5) The city's Internet homepage will soon be expanded to include a listing of all North <br />Olmsted businesses and organizations. This service to businesses will be free; however, if <br />the business wants to have a page of their own, the city has negotiated a discount policy <br />with market. al. By promoting our businesses, we help to keep them profitable and in turn <br />the city earns more taxes. <br />Law Director Gareau: 1) Since the last Council meeting, two lawsuits have been filed by <br />Biskind Development and Daniel Biskind. The first lawsuit was an administrative appeal <br />from the decision of the Planning Commission which refused to consider the rezoning of <br />Parcel E from office use to general retail. This appeal is subject to dismissal because <br />under the City Charter the Planning Commission is an advisory body to City Council and <br />is not a quasi judicial body. The Law Department will ask for dismissal of this lawsuit. <br />The second lawsuit is a declaratory judgment action asking that the zoning that is <br />presently constituted on that property be declared unconstitutional as it applies to that <br />property. In these types of cases, the plaintiff has a very great burden of proof that is <br />beyond fair debate, which is almost beyond a reasonable doubt. However, it is important <br />for the city to have a team of experts to help put on evidence. The Law Department will <br />soon begin to assemble this team of experts. <br />2) There are still two residents who have not disconnected their storm sewers from the <br />sanitary sewers despite repeated requests. Yesterday, a lawsuit was filed asking for <br />injunctive relief. <br />3) The Law Director, Mayor Boyle, Safety Director Kasler, P & A Director Wilamosky <br />and Assistant Law Director Dubelko recently met to review the proposed Civil Service <br />rules and regulations. The final draft is currently being prepared and will be presented to <br />the Civil Service Commission. <br />4) On Friday, a hearing will be held regarding the Fattlar case. <br />5) A brief will be filed in opposition to the AFSCME motion for summary judgment <br />regarding the J. P. Farley litigation with respect to two of the AFSCME members. <br />6) Next week the Law Director will attend atwo-day conference sponsored by the Kent <br />Law School in Chicago dealing with civil rights actions. <br />Mr. Lind, Chairperson of the Finance Committee: 1) The committee met on Thursday, <br />February 27. In attendance were Council Members McKay, Musial, Limpert, O'Grady, <br />Nashar and Lind; Finance Director Burns; Safety Director Kasler; Service Director <br />Bohlmann; Mayor Boyle; Dennis Long, Bob Nichols and Tim Wagner from the <br />Wastewater Treatment Plant. The following agenda items were discussed: <br />a. Ordinance 97-15, dealing with the bidding for two steel platforms to be installed at the <br />Wastewater Treatment Plant. The engineering services will be $16,000, which is included <br />in this year's appropriations. One platform will be constructed around the oxidation <br />reactor, which is used for cleaning sludge. It will restrict repair access to the top of the <br />2 <br />
