Council Minutes of 2/5/97 <br />~, with the city agreeing to pay no more than two hours of travel time in excess of the eight <br />' ~ hours on overnight schooling. This agreement will remain in effect for the duration of the <br />contract which expires on December 31, 1997. <br />3) The Law Department recently met with the court appointed commissioner in the Fattlar <br />case. That issue is currently in the Court of Appeals where we have filed a mandamus and <br />a quo warranto action because they would not stipulate to all of the facts. Another <br />meeting will take place in March to have the issue fully litigated with respect to the facts <br />that are in dispute. <br />4) Another lawsuit has been filed by Mr. Dooling, a NOMBL employee. This lawsuit has <br />been filed against the city and not the officers involved in the issue that prompted the first <br />lawsuit. However, the lawsuit was filed one day after the Statute of Limitations ran. The <br />Law Department has contacted the insurance company seeking permission to handle the <br />litigation and plans on filing for dismissal on the basis of immunity and that the Statute of <br />Limitations has expired. <br />S) The Law Department will file a brief in Common Pleas Court regarding the AFSCME <br />grievance dealing with hospitalization coverage. The employees had filed a grievance <br />demanding arbitration, and the Law Director filed a declaratory judgment action. <br />6) An executive session is requested this evening to discuss threatened litigation with <br />respect to the zoning of the Biskind property that is currently before the Planning <br />Commission. <br />Finance Director Burns: 1) This past Monday, the Finance Department received phone <br />calls regarding the inability of people being able to call the Recreation Center. Callers <br />hearing the message, "The number you have dialed has been disconnected," thought the <br />center had been closed or the city had not paid its phone bill! What really happened was <br />the phone system was temporarily disconnected to be upgraded and, unfortunately, that <br />was the only message Ameritech could use for that situation. <br />2) Previously it had been reported that the city had submitted an application for Issue 2 <br />loan assistance money in the amount of $989,706. The request has been denied. Four <br />cities in the county had applied for loan assistance. Cleveland and Solon were chosen to <br />receive the loans and will receive about half of what was requested. <br />3) The city ended the year with positive cash balances in all funds with the exception of <br />the COPS Fast Fund. By design, the COPS Fast Fund will have a deficit balance since the <br />city has to expend the money before it can be requested from the Justice Department. <br />Fund balances were as follows: General Fund, $S 10,000; Recreation Fund, $78,000; <br />Bond Retirement Fund, $479,000; Bus Fund, $463,000; Springvale, $324,000; Sewer <br />Revenue Fund, $154,000. The target for the General Fund was $250,000, so we more <br />than doubled that target. The target for the Bond Retirement Fund was a half million <br />dollars, and we fell just slightly short of that mark. The target for the Sewer Revenue <br />Fund was to be a break even, and we exceeded our expectations for that fund. <br />2 <br />
