<br />Law Director Gareau: 1) The Law Department has filed the reply brief in the Court of
<br />Appeals dealing with the declaration of the Rocky River Court that the city's tree
<br />ordinance is unconstitutional.
<br />2) A brief has been filed in opposition to the motion to dismiss North Olmsted vs. Scuba
<br />Junction which is in Rocky River Municipal Court.
<br />Finance Director Copfer: 1) On November 11, she attended a Municipal Finance
<br />Officers Association luncheon where Thomas Hayes, RITA executive director, spoke on
<br />House Bill 803 which prescribes uniform assessment, payment, reporting interest and
<br />penalty provisions for municipal income taxes. The problems with this legislation are
<br />many, some with financial implications to our city. This Legislation violates the rights
<br />and obligations of duly elected local officials to determine what is in the best interest of
<br />residents and businesses. It encroaches on North Olmsted's right to self-government and
<br />home rule. She will propose a resolution which clearly states the city's objections.
<br />2) The post-audit conference has been scheduled for 6 p.m. on November 23. This
<br />meeting is not subject to the Sunshine Law and will be a closed session.
<br />Mr. Nashar, Chairperson of the Public Safety Health & Welfare Committee: 1) The
<br />committee met on November 10. Present were committee members Miller, Gareau,
<br />Nashar; Council members Limpert, McKay, O'Grady, Kasler; Mayor Musial; directors
<br />Jenkins, Copfer, Bohlmann; Capt. Ed Bak from the North Olmsted Fire Department. The
<br />following items were discussed:
<br />• Resolution 98-127, a resolution authorizing the Director of Public Safety to advertise
<br />for bids for the purchase of thermal imaging cameras for the Fire Department as
<br />detailed in specifications on file and authorizing the Mayor to contract for the same.
<br />The imaging system is a completely self-contained hand-held camera specifically
<br />designed for fighting fires. The camera is small, weighing about 4 pounds. When
<br />this camera is used in a smoke filled room, the heat sensing device will show the
<br />image of a person in the room. This is a portable camera, and it is battery operated.
<br />It can be clipped onto the firefighters' turn-out-gear. The Fire Department is asking
<br />for two cameras. Over a year ago, the cost of the camera was between $25,000 and
<br />$30,000. Now it is in the range of approximately $20,000. The funds to purchase the
<br />cameras will be generated from the Hotel-Motel Tax.
<br />• Safety Director Jenkins addressed the issue for the need to replace worn and damaged
<br />turn-out gear for the North Olmsted firefighters to protect them from heat and fire.
<br />Turn-out gear includes jackets and pants which are tan in color and have yellow
<br />safety bands going around them. Most of the current equipment has been repaired a
<br />couple times and does need to be replaced. The legislation will be passed under
<br />suspension of the rule so the new equipment can be purchased.
