Council Minutes of 12/21/1999 <br />Mr. Gareau. (At this point, there was confusion as several members of Council requested <br />an explanation of the motion. It was determined that Mr. Limpert was challenging the <br />decision of the Chair not to have the letters read. Mr. Limpert also noted that he wanted a <br />determination of when it would be discussed. Would it go before the Ethics Commission <br />or some other committee or is it something that is going to just simply not be recognized? <br />President Saringer said she did not believe it should be done on this night. Mr. Nashar <br />said he did not believe the letter should ever be read publicly. Mr. O'Grady said, whether <br />Council agrees with the contents of the letter or not, deciding what residents will be <br />listened to or what issues will be heard before the Council is censorship. He believes it <br />might be useful to have an agreement to read the letters at another time, perhaps the first <br />meeting in January. A lengthy discussion ensued as to when the proper time might be or <br />if the letters should be read at all. Mr. McKay felt the issue should not be brought in a <br />public forum. Mr. Limpert agreed with Mr. O'Grady that it starts getting into censorship <br />when Council decides what will or will not be read. Law Director Gareau said it is <br />within the purview of the President of Council to determine whether or not the subject <br />matter of the communication is appropriate to bring before the Council. Council would <br />have to make the determination of how the issue is to be resolved. Mrs. Kasler said she <br />felt, if it is being determined that it is not appropriate to discuss at this forum or with this <br />group of people, then perhaps it is not appropriate at any time to be discussed. It is a <br />personal matter that needs to be addressed outside of Council. Mr. Miller concurred with <br />Mrs. Kasler. Mrs. Saringer said it was her opinion that it shouldn't be discussed.) The <br />roll call was taken on Mr. Limpert's motion to challenge the decision of the Chair: Shall <br />the decision of the Chair be upheld? Limpert, no; Gareau, no with comment that, <br />although one of the communications was from him, he believes that, when some member <br />of Council speaks to an issue, the people have a chance to address those issues. One of <br />the ways they can do that is through communication, regardless of content, regardless of <br />viewpoint. Short of something that disrupts the meeting, he believes it should go <br />forward. Roll call continued: Kasler, yes; McKay, yes; Miller, yes; Nashar, yes; <br />O'Grady, no, with comment that he is not taking a position on one side or the other but, <br />when we have a resident who comes to Council for resolution of some concern, he thinks <br />we owe it to that resident of finding some resolution. It appears from what he is hearing <br />that, depending on who you are, you'll get your letters read or your concerns answered or <br />depending upon who you are, you will not get either. The vote was four yes and three no. <br />The decision of the Chair was upheld. <br />LEGISLATION <br />Ordinance No. 98-94 introduced by Mr. Gareau was given its third reading. An <br />ordinance amending Section 3 51.04 of the Traffic Code of the City of North Olmsted so <br />as to provide increased criminal penalties for unlawful parking at handicapped parking <br />locations on public and private lots, and declaring an emergency. Mr. Gareau moved to <br />table; second by Mr. Nashar; motion passed unanimously. Ordinance No. 98-94 tabled. <br />~~,. <br />8 <br /> <br />
