Counci! Minutes of 12/7/1999 <br />from Cleveland. We should then incorporate high speed trains going into the regional <br />~~,. <br />airport as a core. The high speed trains would come from, for example, Cleveland, <br />~~~ ; <br />Toledo, Columbus and Dayton. Our city is suffering the consequences of noise pollution <br />by having the airplane flight plans changed. We are also suffering the aspect of air <br />pollution by the dumping of fuel and the jet engine exhausts which fall on North Olmsted <br />and surrounding communities. Although the city is prevented from bringing a class <br />action, he has spoken to the Law Director about the possibility of encouraging a class <br />action against the airport. Through this action we could ask for a share of the landing <br />fees and other revenue streams of the airport so as to provide North Olmsted residents, <br />and residents of other surrounding communities, some compensation for the affects on <br />their quality of life. <br />Law Director Gareau: 1) Regarding the Mayor's comments about a class action against <br />the airport, the communities that are affected would have to make arrangements to hire an <br />expert who can identify a commonality. In order to have a class action, you have to have <br />a common impact and you have to be damaged in a common way so that, when you bring <br />an action of that nature, the people who are affected can identify their damages and they <br />can also indicate what potential problems that they are affected by. That obviously would <br />take the resources of an expert who would have to be hired in order to determine whether <br />or not there is commonality. So, if these communities that are affected by it are <br />interested in pursuing that, an organization should be formed to look at the possibility of <br />contacting an expert in that field so that a determination can be made as to whether or not <br />it would be feasible to pursue such an action. <br />2) He and other members of the administration recently traveled to Chicago to meet with <br />the U. S. EPA. We had been talking to the EPA about eliminating the consent decree and <br />the stipulated penalties because we had not had any by-passes or overflows for a period <br />of some 18 months, even though we had heavy rains. We are currently working at the <br />Wastewater Treatment Plant dealing with the issue of phosphate. When we were <br />working with trying to resolve the heavy metals problem that was part of our NPDES <br />permit by changing the sodium aluminate, we ended up having more of a phosphorous <br />problem. Council approved the expenditure to install baffles, and we have had a lot of <br />success with that. We plan to revisit these issues with the U. S. EPA; and, hopefully, we <br />made some points in Chicago. He is very optimistic about working with the U. S. EPA <br />and the U. S. Attorney's office to come to a final and complete resolution relative to this <br />matter sometime within the next four or five months. <br />3) Even though we were supposed to have received a decision in the Parcel E case, we <br />have not yet received it. <br />4) The work of the last seven to ten months has come to fruition with respect to the <br />contract with the Greater Cleveland Regional Transit Authority. (On first reading <br />tonight.) Part of the agreement does deal with the issue of the city making sure that we <br />have some provisions for apark-and-ride. That is an integral part of that agreement. <br />Hopefully, we can resolve that issue in the very near future so that we can finally sign <br />that agreement. <br />2 <br />i <br />
