Ordinance No. 99-107 adopted. <br />Ordinance No. 99-111 introduced by Mr. Miller was given its third reading. An <br />ordinance creating new Section 337.30 of the Traffic Code of the City of North Olmsted <br />so as to prohibit the excessively loud playing of sound devices while operating motor <br />vehicles, and declaring an emergency. Mr. Miller moved for adoption; second by Mr. <br />Nashar. Roll call.: Miller, yes; Nashar, yes; Kasler, yes; McKay, yes; O'Grady, no, with <br />comment that he believes we already have legislation in place that addresses this <br />question. Secondly, he believes that the enforcement is very questionable on this. He <br />wonders if the Police Department will find that this is something that they can enforce. <br />Roll call continued: Limpert, no, with comment that such legislation has been discussed <br />in the past. The Law Department said that it would be totally unenforceable. The Law <br />Department has not weighed in on this particular piece of legislation. There was <br />comment that it is modeled after something in Cleveland. But then again, the Cleveland <br />ordinance also calls for cars being confiscated. That was not really brought to our <br />attention. He thinks everyone would like to do something about some of the disturbances <br />that we get, but he wants to do it right and get something that we can enforce. Ordinance No. 99-111 adopted. <br />Ordinance No. 99-54 introduced by Mayor Musial on behalf of himself, Mr. O'Grady and <br />the entire Council was given its second reading. An ordinance creating new Chapter 177 <br />of the Administrative Code of the City of North Olmsted entitled, "Project Labor <br />Agreements," providing for project labor agreements to be negotiated and adhered to in <br />the course of certain city building and other improvement projects, and declaring an <br />emergency as amended. <br />Ordinance No. 99-112 introduced by Mr. Miller was given its second reading. An <br />ordinance amending Section 745.05 of the Hotel and Motel Tax Code, entitled "Records; <br />Inspection; Destruction," in order to impose a duty upon the Director of Finance to <br />conduct annual audits of excise tax returns filed by hotel and motel vendors in the City of <br />North Olmsted, and declaring an emergency as amended. <br />Ordinance No. 99-113 introduced by Mr. Miller was given its second reading. An <br />ordinance amending Section 1119.01 of the North Olmsted Zoning Code, entitled <br />"Building Permit Required," in order to prohibit commercial and new residential <br />developers from obtaining building permits for real property development when real <br />property taxes are due and owing. <br />Resolution No. 99-114 introduced by Mayor Musial was given its second reading. A <br />resolution authorizing the Director of Public Service to advertise for bids for a maximum <br />of 35,000 gallons of sodium aluminate per each twelve-month period, for use by the <br />Wastewater Treatment Plant, and authorizing the Mayor to contract for same, and <br />declaring an emergency. <br /> <br />13 <br />
