Council Minutes of 5/5/99 <br />AUDIENCE PARTICIPATION <br />~, Dennis Lambert, 25057 Carey Lane, said he felt the landmarks legislation should require <br />proposals to first go to the Planning Commission. He feels the Planning Commission <br />should then require input from the Landmarks Commission. Mr. Lambert feels this <br />would give the process more "teeth." Regarding laser pointers, Mr. Lambert noted that <br />lasers are used to cut steel. Mitsubishi makes a laser machine that acts faster than a <br />stamping press for cutting steel chassis. <br />Norm Baxter, 5294 Willet Circle, would like the legislation regarding "junk" vehicles to <br />be more inclusive to include vehicles that are not licensed. There are commercial <br />locations along Lorain Road in his neighborhood that have kept cars on their property for <br />several years. This is an unsightly situation and the neighbors would like to see the cars <br />removed. Law Director Gareau said the license cannot be a criteria for declaring a <br />vehicle to be junk. There are occasions when a person might need to leave an unlicensed <br />vehicle in their driveway for a period of time. If the law applies to somebody who has <br />left a vehicle for two or three years, it will apply to somebody who has left a vehicle <br />sitting for two to three months. Not having a license cannot be the sole criteria. The <br />vehicle must also be inoperable. Mr. Baxter said he felt the ordinance does not go far <br />enough. He noted that other cities do have laws regarding unlicensed vehicles. Law <br />Director Gareau said that the ordinance was prepared to deal with repair facilities that <br />store vehicles for a long period of time. Perhaps the best way to attack the problem is to <br />look into the business regulation code. He believes it is inappropriate to attack the <br />problem by citing individuals who simply do not have a license plate or have an expired <br />plate on their vehicle. Mrs. Saringer said she agreed with Mr. Baxter that this is a <br />problem and has been a problem for years. A number of years ago, she introduced <br />legislation dealing with this problem and was criticized by a former mayor. She believes <br />the legislation should be looked at further by the Law Director and the committee. Mr. <br />Gareau said he and Assistant Law Director Dubelko had recently discussed this problem. <br />Mr. Dubelko noted that a decision from Franklin County involving an ordinance which <br />had a declaration of nuisance depending upon license plates was struck down as <br />unconstitutional. Mr. Gareau is sensitive to the concerns of Mr. Baxter and others but <br />wants to make sure that we are not telling people to remove private property in the <br />absence of what we believe to be a clear set of standards. We need to take additional <br />time to look at this legislation to be sure that all the holes are closed and it will stand up <br />in court. <br />LEGISLATION <br />Resolution No. 99-41 introduced by Mr. McKay was given its third reading. A resolution <br />authorizing the Director of Public Service to advertise for bids for Phase 3 (1999) <br />improvements in the storm drainage system in the Lansing Drive and Forest Ridge <br />subdivision area as detailed in the plans and specifications on file and authorizing the <br />Mayor to contract for the same, and declaring an emergency. Mr. McKay moved for <br />adoption; second by Mr. Nashar; motion passed unanimously. Resolution No. 99-41 <br />adopted. <br />~. <br />~n <br />7 <br />l <br />
