Council Minutes of 4/20/99 <br />will be responsible for sidewalks, and the city will also enter into a sidewalk repair <br />maintenance/installation program this year. The goals of this inspection program are: to <br />identify properties in need of maintenance repair and have those violations abated; to <br />commend those residents who do a good job of maintaining their properties. The <br />building inspectors will wear jackets identifying them as members of the North Olmsted <br />Building Department. <br />5) ODOT construction on Cedar Point Road has encountered a problem in relocating a <br />utility line. As a result, the contractor has been given approval to completely close Cedar <br />Point Road for 14 days beginning Wednesday, Apri121. <br />6) The world's largest touring grill, the "Johnsonville Big Taste Grill," will be at the <br />Giant Eagle parking lot on Great Northern Boulevard on Saturday, April 24, from 11 a. m. <br />until 5 p.m. Proceeds from the sale of bratwurst and Pepsi will go to the North Olmsted <br />Parks and Recreation Department. WDOK will be broadcasting live from the parking lot. <br />Everyone is invited to come and enjoy a bratwurst and Pepsi for only $1.50. <br />Assistant Law Director Dubelko: 1) Law Director Gareau is recovering nicely from his <br />recent surgery. <br />2) The city has filed a brief in opposition to the Chamber of Commerce's motion for <br />summary judgment. The briefing schedule in this case is almost completed. Hopefully, <br />Judge Nugent will make a ruling on the two motions for summary judgment in the next <br />several month period. <br />3) The Law Department has sent a letter to the Ohio Attorney General asking the <br />Attorney General to investigate afund-raising circular which was sent by the Chamber of <br />Commerce, anon-profit corporation, to local businesses. The circular appeared to be a <br />City of North Olmsted violation notice. The Law Department and other city departments <br />were contacted by a number of businesses questioning whether or not this was a city <br />notice. This issue has been forwarded to the Attorney General to see whether or not any <br />State law provisions regulating charities have been violated by that circular. <br />4) Regarding the Parcel E case, the Law Department had originally filed a brief opposing <br />the property owner's request to bifurcate the trial. Typically a trial of this nature (a <br />zoning case), is composed of two parts: a claim that the city zoning ordinance is <br />unconstitutional and also that it takes property without compensation. The property <br />owner has filed a motion to separate that into two trials, and the city has opposed that. <br />That case is still set for trial on June 15. <br />5) Also, in connection with Mr. Bohlmann's report on the termination of the U.S. EPA <br />consent decree, the Law Department has contacted the U. S. Attorney's office and is in <br />the process of scheduling a meeting which should lead to the termination of that decree. <br />6) In the case of Griffith vs. the City of North Olmsted (jail suicide case), our insurance <br />defense counsel reports that the case has been set for trial on October 12 of this year. It is <br />in the middle of discovery right now and there are some settlement discussions and there <br />is the possibility of the city filing a motion for summary judgment. <br />Finance Director Copfer: 1) The operating system upgrade for the financial computer <br />system was completed on Saturday, April 17. The system is being tested and it is <br />anticipated the Y2K software will be loaded within the next two weeks, followed by <br />more testing. <br />
