Council Minutes of 3/16/99 <br />Given this dispute, the committee recommended that the proposal be returned to <br />Planning Commission for further discussion. However, Building Commissioner <br />Conway has noted that the city has not taken a position against the use of interior <br />neon lighting for signage. Rather, they have taken a position against the use of accent <br />and tube lighting, such as lighting that might go around the outside of the building <br />used solely to attract the attention of passers-by. With the recommendation of <br />Building Commissioner Conway, Suburban Auto Body would need only return to the <br />Architectural Review Board for review of their sign package. Also discussed that <br />evening with Suburban were traffic patterns flowing to the south of the building with <br />traffic coming from both the bank and gas station located to the east and traffic <br />coming from the former Best Products. Traffic seems to come from all different <br />directions in that area and there really is no street-in fact it is anon-dedicated street. <br />Traffic Engineer Larry Griffith made some suggestions and recommendations <br />concerning this traffic pattern and this problem which has existed for some time. He <br />made a suggestion perhaps to even include closing off the area to avoid cut-through <br />traffic. The property owner discussed this matter and stated that he believed there <br />was an easement in place that was granted to the bank which allowed such cut- <br />through traffic. A discussion was had by the committee not to interfere with the <br />easement or obstruct the easement and let matters proceed as they currently are. It <br />should be noted that the recommendations and suggestions of the city Traffic <br />Engineer were just that-he did indicate in his memo that, if it was not possible to do <br />what he had suggested, then he had no problem with the plan as presented. After <br />discussion, review and dialogue with the presenters, the BZD Committee <br />unanimously recommended approval subject to a final approval of the drainage plan <br />as well as subject to a return to the Architectural Review Board for the sign package <br />and also subject to the recommendations of the boards and commissions of the City of <br />North Olmsted. Mr. Gareau moved that Council approve subject to all the <br />suggestions and recommendations of the committee and the boards and commissions. <br />The motion was seconded by Mr. McKay and unanimously passed. <br />• Halleen Kia, a preliminary proposal to construct a Kia car dealership on the corner of <br />Dewey Road and Lorain Road, just slightly west of Porter. This was a matter brought <br />to the BZD Committee on an informal basis as a preliminary review and afollow-up <br />to a previous preliminary review for the purpose of ascertaining suggestions and <br />comments from members of the BZD Committee as well as from neighbors who may <br />be offended by this development. At the outset, Councilman Limpert discussed that a <br />notice had been sent to several property owners in the neighborhood concerning the <br />proposal and the notice advised that a meeting would be held on that day at City Hall. <br />It was clarified by Mr. Limpert that this was merely an informal notice and was not a <br />notice pursuant to any Charter provision or ordinance provision. Several residents <br />thereafter protested and said that they in fact had not received notice of the meeting, <br />and they objected to the meeting going forward. It was pointed out to the residents of <br />that area that not only was notice not required but in fact the meeting itself was not <br />even required. This was strictly an effort to get their wishes and concerns to this <br />proposal prior to actually implementing the proposal through submission to the <br />Building Department.
