Council Minutes of 3/16/99 <br />discussing this matter was Assistant Director of Law James Dubelko, who was also <br />involved in drafting the ordinance and working together with Mr. Hunt, Building <br />Commissioner Conway and City Engineer David McDermott. A specific concern <br />was the exact scope of Ordinance 98-131 whereby these wireless telecommunications <br />towers would be permitted to be located in the City of North Olmsted. There has <br />been quite a bit of concern recently as to various issues regarding these towers <br />including, but not limited to, such matters as where the towers can be located and <br />how high they can be. Seeking to clarify this, Mr. Dubelko explained that one area <br />within the City of North Olmsted where towers would be potential conditional uses <br />would be in the Limited Industrial area on the far west end of the town. The towers <br />would be conditional uses only in these districts and would still be subject to <br />extensive regulation. It had been unclear whether the northern area of Lorain Road, <br />because the Industrial District extends to both the north and south in that area, would <br />be included. Mr. Dubelko clarified that in fact the north side of Lorain Road was <br />included. It was also discussed that Mr. Hunt recommended other properties within <br />the City of North Olmsted where towers could be located-one suggestion being <br />property owned by the schools. This position was unanimously rejected by the <br />committee. After discussion, the committee unanimously recommended approval of <br />Ordinance 98-131. <br />• A discussion of the current noise ordinance-how it impacts upon residential <br />properties adjacent to Great Northern Shopping Plaza. Specific discussion was had <br />concerning Codified Ordinance 741.03 concerning deliveries to commercial property. <br />At the last Council meeting, several residents complained about trucks running their <br />engines while making deliveries at different hours of the day. In response, Mr. <br />McKay referred the matter to the BZD Committee, and the committee reviewed the <br />current ordinance in place which protects these residents. To summarize the current <br />ordinance, no person is permitted to make deliveries or cause to be delivered any <br />product within 250 feet of a residential building between the hours of 11 p.m. <br />and 7 a.m. It was recommended the times be changed to 9 p.m. and 8 a.m. Another <br />provision that was recommended to be changed was the provision requiring that no <br />person make deliveries or permit their engine to run for more than 10 minutes <br />between 11 and 7. The time of that section was changed to 9 p.m. to 8 a.m. and the <br />10 minutes provision was excluded. Mr. McKay asked that the committee's <br />recommendations be put into an ordinance, and Ordinance 99-37 is on this evening's <br />agenda. <br />Mr. Nashar, Chairperson of the Public Safety, Health & Welfare Committee: 1) The <br />committee met on March 9. Present were committee members Miller, Gareau and <br />Nashar; Councilmen O'Grady, Limpert and McKay; Safety Director Jenkins. The <br />committee discussed Ordinance 99-33, an ordinance amending Section 521.08 of Chapter <br />521 of the General Offenses Code entitled Health, Safety and Sanitation so as to prohibit <br />the outdoor storage of motor vehicles without current or valid license plates. The <br />committee discussed the ordinance at great length and decided to hold it for further <br />review and discussion and possible addition of language defining "junk" cars and <br />vehicles. The committee feels that the additional language will help the Building <br />Department address these issues. <br />7 <br /> <br />
