This public <br />.~..~. <br />hearing concludes what we had planned to do to make sure that plenty of citizen input <br />went into the CDBG application. <br />Mr. Gareau, Chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met on February 8. Present were committee members Gareau, Miller and <br />McKay; Councilpersons Nashar, Kasler and O'Grady; Safety Director Jenkins; Assistant <br />City Engineer McDermott. There were two items on the agenda that evening: <br />• Ordinance 98-131, an ordinance providing for the amendment of the Zone Map of the <br />City of North Olmsted in order to supplementally zone the hereinafter described <br />parcels of real property so as to include them within the new wireless <br />telecommunications facilities overlay district (WTFO) of the City of North Olmsted. <br />This is a companion ordinance to 98-130, which added a new Chapter 1151 of the <br />Zoning Code entitled "Wireless Telecommunications Facilities Regulations" and <br />"Wireless Telecommunications Facilities Overlay District." While the initial <br />Ordinance 98-130 regulated telecommunications towers within the city, including the <br />overlay district, the second ordinance before the committee that evening actually <br />created the overlay district whereby towers could exist within certain areas of the City <br />of North Olmsted where otherwise it would not have been permitted. The overlay <br />district that was created permits these telecommunications towers to be located in the <br />Light Industrial District on the far west end of town off to the east and southeast <br />corner of North Olmsted near Springvale Golf Course and on or in the Interstate 480 <br />right-of--way. It is important to remember that despite the permission to locate in <br />these areas, they are still heavily regulated as to setbacks, screening, size and matters <br />to that effect. Merely being able to place them in these districts does not necessarily <br />make them unregulated. After discussion, the committee unanimously recommended <br />approval. <br />• Ordinance 99-10, an ordinance providing for the submission to the electors of the <br />City of North Olmsted of an amendment to Article X entitled "Initiative, Referendum <br />and Recall" of the Charter of the City of North Olmsted to require that every initiative <br />or referendum measure on the ballot involving the rezoning of any parcel or parcels <br />of land in the city be approved by a majority of the city-wide vote and by a majority <br />of the voters residing in the ward or wards of the city where any part of the parcel or <br />parcels are located. This was not a new matter before this particular committee-it <br />was discussed during the last committee report and was also discussed early last year <br />when several residents appeared before the committee and Mr. McKay requested that <br />we look into this particular type of legislation. In essence, in the event that we have <br />an initiative or referendum rezoning brought forward by a property owner or a <br />resident whose property adjoins a particular piece of property and, if that matter is put <br />on the ballot, it must pass in both the city by a simple majority, as has always been <br />the case, as well as by a simple majority of the ward or wards where the property is <br />located. This ordinance is sponsored by the Mayor and entire Council. After <br />discussion, the committee concluded that it was in the best interests of the community <br />and unanimously recommended approval of Ordinance 99-10. <br />._. ,w...~..~~..~.~. ,.. . <br />
