MINUTES OF THE PUBLIC HEARING <br />CITY OF NORTH OLMSTED <br />FEBRUARY 29, 2000 <br />7:15 p.m. <br />Present: Council President Saringer, Council Members Gareau, Kasler, Limpert <br />McKay, Miller, Nashar, O'Grady <br />Also Present: Clerk of Council Seman <br />Council President Saringer called the public hearing to order at 7:15 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />President Saringer announced that the public hearing was being held with regard to <br />Ordinance No. 99-82 which was introduced by Councilman Gareau. This is an ordinance <br />creating new Section 1126.08 of the Zoning Code of the City of North Olmsted, entitled <br />"Deviations from Approved Plans Prohibited," in order to provide for better remedies <br />against commercial and other developers who, in constructing buildings and other <br />improvements to land, deviate from plans approved by the city, as amended. <br />AUDIENCE PARTICIPATION <br />Shannon Hickman, 25320 Clubside Drive, #8, believes this is a "great thing" because she <br />and her neighbors have been subjected to "hideous landscaping" behind Home Depot. <br />Ms. Hickman noted that Home Depot had not followed the plans as submitted. They <br />made the mound bigger, but still put in the same number of plantings which makes it look <br />sparse. Also, they did not bring in fill dirt but used materials (concrete blocks, tubing, <br />wiring, etc.) from the demolition of the Handy Andy store. The plantings that are they <br />are not growing because of this fill. (Ms. Hickman distributed pictures of the site. ) <br />Mrs. Kasler noted that the city now has in place legislation which requires that <br />landscaping be maintained and the contractor must live up to the plans presented to the <br />city. Mr. McKay said that he, Mr. Jenkins and the Mayor had visited the site with the <br />landscaper who had promised to put in new shrubbery (pine trees) and new grass by last <br />September. Ms. Hickman said that the pine trees had not been replaced, the dead ones <br />were still there. Also, instead of grass, mulch has been put in. When it rains, the mulch <br />runs down the sides and goes into the street which causes a clog in the sewers and <br />backyard flooding. Along discussion ensued, and it was generally agreed that this was <br />an enforcement issue. It was also agreed that the city should determine what the proper <br />materials are to be used as "fill" so that contractors cannot use debris. Without <br />legislation in place, it is difficult for the Building Department to enforce the plans as <br />presented. <br />Council President Saringer djourned the public hearing at 7:40 p. <br />.. <br />,~, <br />Barbara L.
