Council Minutes of 11/7/2001 <br />~,,, 3) Another matter to be discussed in the executive session is that he has entered into the <br />final stages of negotiation and has reached a tentative settlement, pending the approval of <br />City Council and preparation of legislation, with respect to the U. S. EPA case vs. the <br />City of North Olmsted. This is in regards to the agreement that the city entered into in <br />1996 with respect to findings and orders of the U. S. EPA. In that agreement was a <br />provision that the city could terminate the agreement for the judgmeirt entry if there were <br />no violations for one year. That is a long history, and he wants to discuss the final <br />resolution of that with the City Council. <br />4) The firefighters have given notice to begin negotiations for the renewal of their <br />collective bargaining agreement. <br />5) The Law Department is still in the process of negotiating with Clague Road residents <br />to acquire the properties so that Clague Road can be widened. <br />Councilman Miller, chairperson of the Recreation, Public Parks and Buildings <br />Committee: 1) The committee met on October 29 to discuss Ordinance 2001-122. <br />Present were Assistant Law Director Dubelko; committee members Limpert, Kesler and <br />Miller; Council President Beringer, Council member O'Grady; Todd Morgan and Betsy <br />Drenski from the Recreation Center. The committee discussed the terminology of <br />Ordinance 2001-i22 that referred to the person involved in that issue, Jeff Marshall, as a <br />Director. It was felt that terminology may imply somehow that the person is an employee <br />of the city, and he is not an employee of the city. It was not the intention that he be <br />viewed as an employee. In fact, the contract reads specifically that, "The city and the <br />contractor acknowledge and agree that the contractor is not an employee of the City of <br />North Olmsted, is not ernitled to any benefits whether arising by virtue of federal, state or <br />local law, to which employees of the City of North Olmsted are ernitled. The <br />contractor's relationship with the city is strictly contractual and is exclusively defined by <br />the terms and conditions of the contract." The committee decided to amend the <br />legislation to read, "An ordinance authorizing the Mayor of the City of North Olmsted to <br />enter into a contract with Jeff Marshall to provide services to the city as the Coordinator <br />of Ice Skating at the North Olmsted Recreation Center and declaring an emergency." <br />Further, Safety Duector Jenkins explained that various comractors at the Rec Cerner are <br />listed as "Directors" and he planned to review those titles and remove the ward <br />"Director" from those positions and use something more appropriate so there is no <br />misunderstanding as to the status of those individuals. However, because of the size of <br />this contract, it was felt that it should come before Council. <br />Councilman O'Grady, chairperson of the Public Safety, Health & Welfare Committee: 1) <br />The committee met on October 25. Present were committee members O'Grady, Kesler <br />and Limpert; President of Council Beringer; Council members McKay, Miller, Dailey <br />and Nashar; Traffic Engineer Griffith, Safety Director Jenkins and Building <br />Commissioner Conway. Agenda items were as follows: <br />• Ordinance 2001-130, sponsored by Council member Dailey. This is an ordinance that <br />amends the Traffic Control File of the City of North Olmsted by providing for the <br />installation of stop signs for the northbound and southbound traffic on West 231 at <br />the iirtersection of West 231 and Maple Ridge Road.
