Council Minutes of 11/7/2401 <br />with regard to this ordinance, it was suggested by Mr. Dailey that it remain in <br />committee pending a decision on traffic warrants. Based on Mr. bailey's <br />recommendation, the committee unanimously voted to hold Ordinance 2001-130 in <br />committee. <br />• A liquor license for Rite Aid of Ohio, DBA Rite Aid Pharmacy #3155 at 28974 <br />Lorain Road, in the City of North Olmsted. This is a C1, C2 license. A C1 license <br />calls for beer only in original sealed containers for carry-out only until 1 a.m. A C2 <br />calls for wine and certain pre-packed mixed drinks in sealed containers for carry-out <br />only until 1 a.m. After short discussion, and with the understanding that the North <br />Olmsted Police Department had no objections, the committee unanimously <br />recommended that Council have no objection. Mr. O'Grady moved that Council have <br />no objection to the liquor license for Rite Aid of Ohio, DBA Rite Aid Pharmacy, <br />#3155, 28974 Lorain Road. The motion was seconded by Mr. McKay and passed <br />unanimously. <br />Councilman Limpert, chairperson of the Streets & Drainage Committee: 1) The Streets <br />& Drainage and Finance Committees met jointly on October 25. Present were President <br />Saringer and all members of Council. The committee discussed Resolution 2001-125, a <br />resolution to go out for bids for gabion baskets. We have been doing more of this sort of <br />work, and it was felt by the administration that the quantity was such that we should go <br />out for bids to acquire them all at once. Members of the Council had concerns as to the <br />number of baskets to be purchased, the expected cost and where the baskets were to be <br />used. Because Service Director Bohlmann was unable to attend, it was decided to hold <br />this piece of legislation in committee until those questions could be answered. <br />Councilman Dailey, chairperson of the Transportation Committee: 1) The committee met <br />on October 25. In attendance were committee members Dailey, Kasler and O'Grady; all <br />Council members as well as President of Council Saringer; Safety Director Jenkins and <br />Traffic Engineer Griffith. The committee discussed Ordinance 2001-129, an ordinance <br />amending Sections 305.01 and 305.02 of Chapter 305 of the Traffic Code of the City of <br />North Olmsted entitled "Traffic Control" in order to include crosswalks as traffic control <br />devices subject to the regulatory provisions of Chapter 305, and declaring an emergency. <br />Discussion centered around the question of whether Council is obligated to regulate <br />crosswalks. Pending discussion with the Law Department, the committee voted <br />unanimously to hold the legislation in committee. <br />Councilman Nashar, chairperson of the Building, Zoning and Development Committee: <br />1) The committee met on October 25. Present were committee members McKay, <br />O'Grady and Nashar; Council members Limpert, Dailey, Miller, Kasler, President of <br />Council Saringer; Building Commissioner Conway and Traffic Engineer Griffith. The <br />committee discussed Ordinance 2001-131, an ordinance introduced by Councilman <br />Limpert. Ordinance 2001-131 amends Section 1363.07 of Chapter 1363 of the Real <br />Property Maintenance Code entitled `duties and Responsibilities of Owners and <br />Operators" so as to require the removal and replacement of fences on commercial <br />property abutting residential property which have fallen into a state of disrepair such as <br />would require repair or replacement of more than 50% of the fence.
