Council Minutes of 10/16/2001 <br />Auxiliary officers will be used for traffic control at the Clague Road Congregational <br />Church. <br />6) Today, the RTA board met and awarded a contract for $218,000 to R. L. Bowen & <br />Associates of Cleveland for final design and architectural engineering services for the <br />North Olmsted transit center near the intersection of I-480 and Columbia Road. The <br />facility, which is expected to cost more than $2 million to construct, will include some <br />350 parking spaces, a building waiting area for passengers, extensive landscaping and a <br />noise wall. <br />Law Director Gareau: 1) He reported in caucus about the progress that we are making <br />with the Board of Elections case. Most people by now understand that we had obtained a <br />temporary restraining order from the Supreme Court regarding the issuance of absentee <br />ballots until the court can look at the issue that was raised with respect the failure of the <br />Board of Elections to re-precinct the wards that were established by the City Council. He <br />submitted an affidavit to the Supreme Court as a part of the evidence that the failure to <br />re-precinct and, if we would vote in the wards as they were previously established in the <br />previous precincts, hundreds if not into the thousands of people would be <br />disenfranchised. It's a very serious matter. The Law Department prepared and filed the <br />merit brief and evidence with the Supreme Court. Assistant Director of Law James <br />Dubelko spent the entire night on Tuesday, October 9, at the office writing the brief. He <br />then had it transmitted to Columbus and filed with the Supreme Court. The Board of <br />Elections filed their brief today. Once again, Jim Dubelko will be at the office putting <br />together the brief so that it can be filed tomorrow in the Supreme Court. We expect a <br />ruling from the Supreme Court either late this week or early next week. <br />2) With respect to the library, we were supposed to have a meeting last evening regarding <br />the contract with the project manager. We received communication from the library <br />board that they did approve the party that we had chosen but wanted some modifications. <br />The Law Department, the Service Department and Mayor's office are currently looking <br />into that issue to determine what type of agreement can be made regarding how the <br />architect is going to work with the construction manager and how the city is going to <br />work with everybody. <br />3) On the Clague Road widening project, there are nine property owners involved. The <br />Law Department has appraisals and has made offers to all nine owners and are close to an <br />agreement with five of them. Assistant Law Director Dubelko and he met on Sunday to <br />prepare agreements, gather documents and review the status of the project. Letters, along <br />with proposed purchase agreements and deeds and other types of agreemenrts, were sent <br />to four of the owners. Hopefully, these four owners will be under contract very soon. <br />Finance Director Copfer: 1) The third quarter investments made report was distributed to <br />Council today. <br />President Saringer reported on the public hearings held on October 15: <br />1) A public hearing was held at 7 p.m. on Ordinance 2001-108. This ordinance amends <br />Section 1123.09 of the Zaning Code in order to establish a clear procedure for notice to <br />be given to condominium property owners affected by requested variances.
