Council Minutes of 5/1/2001 <br />• Regarding Ordinance 2001-46, he asked Mrs. Kesler whether other cities have such <br />an ordinance. Mrs. Kesler said it was based on a Parma ordinance, and it was also <br />proposed in Elyria. She does not know how many other cities have these standards <br />but does believe there are others. Mr. Colwell was unsure about the use of the word <br />"mandatory." Mrs. Kesler said mandatory means it must be disclosed. If a contractor <br />does not disclose the requested information, they are disqualified. Since there are <br />sixteen standards listed in the ordinance, he asked how many of them must be <br />disclosed now without the legislation. Mrs. Kesler said the list submitted by the <br />administration at the committee meeting included eight items. Those eight items <br />actually came from the sixteen in the ordinance. However, it is her understanding <br />that similar standards were required at all times. What this ordinance does is expand <br />on the number of standards that need to be disclosed, the amount of information that <br />should be disclosed, and requires that it is done at the initial step in the bidding. It is <br />part of the specs as opposed to being required later. We put the problems out front <br />and on the table so that everybody knows what they have to submit and everybody <br />has to submit the same information. <br />Regarding Mr. Colwell's comments about the traffic synchronization, Councilman Miller <br />noted that the system was not necessarily designed to allow someone to drive from one <br />end of Lorain Road to the other without stopping for a red light. It was designed to make <br />the traffic flow as smoothly as reasonably possible. Sometimes traffic on Lorain Road <br />has to fop to allow the traffic on the north/south routes to enter Lorain Road. <br />9) Larry Orlowski, 4804 Bailey Road. <br />• Most governmental entities work under mandatory minimum standards. The zoning <br />ordinances within the city set minimum standards that are required. The Building <br />Department works under mandatory minimum standards for remodeling or <br />construction. The minimums can be exceeded to make a project better, but there are <br />always minimums which must be adhered to. <br />10) Don Pangrac, 23470 Sharon Drive. <br />• Where does the Sharon Drive project stand? Mrs. Copfer said that the contract was <br />on her desk waiting for the bonds to sell. The project has already been out to bids <br />and approved by the Board of Control. She cannot sign the contract and send it out <br />until the money is in the process of collection. The bonds will probably sell next <br />week. The Mayor promised Mr. Pangrac that his request for atwo-week notification <br />before construction begins will be done. <br />LEGISLATION <br />Ordinance No. 2001-46 introduced by Councilwoman Kaslex was given its third reading. <br />An ordinance creating new Section 111.02 of Chapter 111 of the City Administrative <br />Code, entitled "Mandatory Minimum Contracting Standards Relating to Bidder <br />Responsibility" which provides for the establishment of minimum contracting <br />responsibility standards to be imposed upon all bidders on city contracts involving <br />improvements to real property.
