' Council Minutes of 12/17!2002 <br />x- LEGISLATION <br />Ordinance No. 2002-181 introduced by Mayor Musial was given its third reading. An <br />ordinance amending Section 1501.1502 of the Municipal Income Tax Code to establish a <br />penalty for the late filing of city income tax returns and to increase the minimum <br />penalties for the late payment of city income taxes, and declaring an emergency. <br />Councilman McKay moved for adoption. The motion was seconded by Councilman <br />Limpert. Roll call: McKay, yes; Limpert, yes; Kasler, yes; Dailey, yes; Miller, yes; <br />Gareau, no, with comment that he has along-standing issue with the way that RITA <br />conducts its business and how it deals with taxpayers in the City of North Olmsted. <br />Unless he can hold them accountable for the way that they conduct themselves, he does <br />not want to penalize the residents of North Olmsted in the event that they don't follow the <br />cryptic instructions from RITA. Roll call continued: Nashar, yes. The motion passed <br />with 6 yeas and one nay. Ordinance No. 2002-181 adopted. <br />Ordinance No. 2002-183 introduced by Councilman Gareau on behalf of the Mayor was <br />given its third reading. An ordinance amending Ordinance No. 98-140, as previously <br />amended by Ordinance No. 2000-29, so as to increase the program fee for participants in <br />the city's Community Diversion program, in order to address an anticipated decrease in <br />funding from the County for the city's program for the year 2003, and declaring an <br />emergency. Councilman Gareau moved for adoption. The motion was seconded by <br />Councilman Nashar and passed unanimously. Ordinance No. 2002-183 adopted. <br />Ordinance No. 2001-130 introduced by Councilman Dailey was given its second reading. <br />An ordinance amending the Trai~c Control File of the City of North Olmsted by <br />providing for the installation of "stop" signs far northbound and southbound traffic on <br />W. 231` Street at the intersection of W. 231` Street and Maple Ridge Road. Councilman <br />Dailey moved to table the ordinance. The motion was seconded by Councilman Miller <br />and passed unanimously. Ordinance No. 2001-130 tabled. <br />Ordinance No. 2000-161 introduced by Councilman Gareau was given its second <br />reading. An ordinance creating new Section 165.16 of Chapter 165 of the Administrative <br />Code of the city of North Olmsted, entitled "Procedwe for Minor Changes," in order to <br />establish an expedited approval procedure for minor changes in historical structures and <br />other structures located in historical districts, and declaring an emergency, as amended. <br />Ordinance No. 2002-184 introduced by Mayor Musial was given its second reading. An <br />ordinance to make appropriations for current expenses and other expenditures for the City <br />of North Olmsted for the year ending December 31, 2003 as amended. Councilman <br />Gareau moved to table Ordinance 2002-184 and noted that there was a substitute, <br />Ordinance 2002-208. The motion was seconded by Councilman Dailey. Roll call: <br />Gareau, yes; Dailey, yes; Nashar, yes; Kasler, yes; Miller, yes; Limpert, no, commenting <br />that the replacement ordinance has not had committee review. Roll call continued: <br />McKay, yes. The motion passed with six yeas and one nay. Ordinance No. 2002-184 <br />tabled. <br />18 <br />
