The average number of cases continued each <br />month is 15. <br />4) The Ohio General Assembly has passed SB 106, and it is now waiting the Governor's <br />signature. This bill will restore premises and streets immunity for local governments. <br />That was a needed type of immunity which had been included in HB 350 which had been <br />passed several years ago. However, it was included among those provisions which were <br />struck down in the Sherwood case because of the violation of the one subject rule. It <br />would pretty much limit the city's liability from curb to curb rather than from the entire <br />right-of--way as far as tort claims. In addition, it removes the language that permitted <br />cases to be based upon nuisance. It's a good act for municipal corporations with respect <br />to immunity defenses. <br />5) On December 12, he appointed Michael Murman a special prosecutor for the city in <br />connection with the police investigation of the anonymous memorandum allegedly <br />prepazed by a member of the administration and brought to the atterrtion of this Council <br />at the November 19 Council meeting. Mr. Murman is awell-respected former Assistant <br />County Prosecutor, former Law Director and Prosecutor for the city of Lakewood. He is <br />a member of the Ohio State Baz Association's Ethics Committee and is a frequent <br />speaker on ethical issues at municipal law seminazs. He is confident that he will provide <br />appropriate counsel to the Police Dept. in this matter. <br />6) On December 13, he received a copy of the fact finder's report on the fire fighter <br />collective bargaining negotiations. As required by law, he will review that report with <br />Council in executive session at the end of this meeting. <br />7) Also on December 13, as the Mayor has mentioned, he met with the Mayor and <br />Finance Director and representatives of Rocky River to discuss mayor's court issues and <br />particularly a proposal by Mayor Knoble to shaze Rocky River revenues generated by <br />court costs which aze in excess of expenses for operating and maintaining the court. He <br />thinks it a good proposal on Mayor Knoble's part. <br />8) He has transmitted a memorandum to the Mayor and all members of Council regarding <br />the status of the mayor's court initiative. He has requested that it be returned to <br />committee for further consideration of potential amendments to the legislation. <br />9) To the President of Council, members of City Council, all members of the city <br />administration and all employees of the city a very happy and peaceful holiday season <br />and a much better year for the City of North Olmsted in 2003. <br />Finance Director Copfer: 1) She expressed her appreciation to City Engineer, Paul <br />Deichmann, for his years of service. She has had the pleasure of working with him for <br />the last five years. He has been very patient and very kind in sharing information, and <br />she has learned a lot about storm sewers, slab repair, sanitary sewers and working with <br />contractors and what a change order is. It's been an honor to work with a man that has <br />such a high level of integrity. She will miss him very much, and she knows that the city <br />will too. Best of luck to him in whatever form his retirement takes. <br />2) On December 1, the city paid its bonded debt payment of $4,697,856, of which the <br />principal amount paid down was $2,935,000. On December 15, $950,984 was paid, of <br />which $925,000 was principal reduction. <br />3) She has received new estimates of what is in the estate tax pipeline so far for which the <br />settlement period is at the end of February of next yeaz.
