Council Minutes of 11/19/2002 <br />;; Resolution No. 2002-156 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the Director of Personnel and Administrative Services to advertise <br />for bids for Police Professional Liability, Property & Scheduled Equipment, Crime, <br />Comprehensive Liability, Auto Liability & Physical Damage, Public Officials Errors and <br />Omissions, Boiler & Machinery, EDP, Umbrella, and Liquor Liability insurance as a <br />package, authorizing the Mayor to enter into a contract for said insurance package with <br />the lowest and best bidder, subject to approval by the Board of Control, and declaring an <br />emergency. Councilman McKay moved for adoption. The motion was seconded by <br />Councilman Limpert and passed unanimously. Resolution No. 2002-156 adopted. <br />Ordinance No. 97-66 introduced by Mayor Boyle was given its second reading. An <br />ordinance enacting Section 763 of the Codified Ordinances of North Olmsted entitled <br />"Video Surveillance," and declaring an emergency. Councilman Nashar moved to table <br />Ordinance 97-b6. The motion was seconded by Councilman McKay. Councilwoman <br />Kasler questioned who made the decision to table to table the ordinance. Councilman <br />Nashar said he had as the legislation has been discussed in the past and no one has made <br />an attempt to bring it forward. The issue can be introduced again in the future if someone <br />should choose to do so. Law Director Dubelko said it was his recollection that work on <br />this Legislation was done in the Law Department, but there were some concerns in the <br />business community. Mrs. Kasler said she had worked on this with former Law Director <br />Gareau and feels that there is more to be done. Roll call: Nashar, yes; McKay, yes; <br />Miller, yes, noting that his vote to table should not be construed as opposing this in <br />concept. Roll call: Limpert, yes; Kasler, no; Gareau, yes; Dailey, yes. The motion <br />passed with six yes votes and one no vote. Ordinance No. 97-66 tabled. <br />Resolution No. 2002-150 introduced by Mayor Musial was given its second reading. A <br />resolution authorizing the Mayor to advertise for bids for the new North Olmsted branch <br />library construction contract as detailed in the plans and specifications on file in the <br />office of the Mayor, further authorizing the Mayor to contract for the same, and declaring <br />an emergency. Councilman Nashar moved for suspension of the rule requiring three <br />readings, and the motion was seconded by Councilman Limpert. Roll call: Nashar, yes; <br />Limpert, yes; McKay, yes; Miller, yes, with the understanding that the Mayor has assured <br />Council that the bids will not include any gazebo and that, if there are change orders with <br />regard to the geothermal issue, that those won't be a burden upon the city. Roll call <br />continued: Dailey, yes; Gareau, yes; Kasler, yes, echoing Mr. Miller's comments. The <br />motion passed unanimously. As the resolution was being passed under suspension of the <br />rule, President O'Grady invited members of the audience who wished to speak regarding <br />this legislation to come forward: Dennis Lambert, 25057 Carey Lane. "It's nice that <br />everybody's put their stipulations in-the legislation flies as it is. It gets passed. It's <br />passed unconditionally. If the geothermal system costs you another ten million dollars, it <br />costs you another ten million dollars. If you hit solid rock 250 feet down, it's solid rock <br />250 feet down. You're stuck with it folks." Mayor Musial asked to hear Mr. Miller's <br />comments again. Mr. Miller said he did not have them written down, but he spoke about <br />two issues: 1) A gazebo will not be part of the bid specs; 2) Any change orders in <br />relationship to the geothermal system will not be a burden upon the city.
